Farris will be hosting two tours this summer for students entering their second year of law school who were not able to attend an organized school tour. The tours are scheduled for Wednesday, June 24 at 2 PM and Wednesday, July 8 at 2 PM at our Vancouver office (suite 2500-700 W. Georgia Street). Please RSVP here: https://docs.google.com/forms/d/e/1FAIpQLSe2ZSzF1O7isBpK37tvd16CLhuEeUNMcKQWNPxvg8l816VCfA/viewform for one of the tours by Friday, June 12. We have 25 spots available for each tour, and snacks will be provided.

We request that students sign up for only one tour and only if they did not already visit us on their school tour, as this will be a similar experience. If the 25-seat maximum is reached for either tour, students will be placed on a waitlist and will receive an email confirming their waitlist status.

Miller, and Associate Thomas Rodgers, recently wrote for Lexpert’s Legal Insights series on the approach of BC courts to the use of Certificates of Pending Litigation (CPLs) as a strategic tool in disputes. The article, “Locking the war chest: Certificates of pending litigation in modern practice”, discusses the sufficiency of connection needed before BC courts will recognize an interest in land and sustain a CPL, and the distinctions that arise between verbal and written contracts. Erica Miller is a Partner in the litigation group at Farris. She assists clients in a broad range of litigation matters, including administrative and regulatory matters, mining disputes, construction disputes, contractual disputes, estate and trust disputes, international trade matters and general civil litigation matters. Erica has represented parties in a variety of matters before the all levels of court in BC, as well as before various administrative tribunals.

Thomas Rodgers is a commercial litigator who helps clients navigate disputes across a wide range of industries. His experience spans contractual breaches, oil and gas matters, construction deficiencies, professional liability, debt claims and insurance.

Farris Partner Kevin Smith and Associate Thomas Rodgers were recently successful in the BC Court of Appeal for our client, the BC Mainland Cricket Association, which operates the oldest cricket league in North America. The appeal turned on whether a governing rule adopted by the Association which restricted participants from also playing within a competitor league was contrary to the Association’s constitution and bylaws. The BC Supreme Court had found that the rule was invalid on the basis that it contradicted the Association’s purposes which included “promoting and fostering” the game of cricket. Retained as new counsel on appeal, Kevin and Thomas successfully argued that the chambers judge erred in adopting an unduly narrow reading of the Association’s purposes and by not interpreting the constitution and bylaws holistically, overturning the BCSC decision in favour of our client.
