When a debtor enters a Companies’ Creditors Arrangement Act (CCAA) proceeding, the impact can extend to payment obligations, contracts, suppliers, creditor claims, and voting rights. Creditors may face a stay of proceedings and must take steps to preserve and prove their claims, monitor the restructuring process, and protect their interests.

ONBusinessDisputes.com outlines the impact of CCAA proceedings, including the stay of proceedings, ongoing supplier relationships, plans and creditor claims, voting rights, the Monitor’s role, and potential restructuring or sale outcomes.

Congratulations to Jason Lattanzio and Brandon Cook on achieving a successful result in the Ontario Superior Court of Justice.

The pair attended an almost month-long trial and argued the issues of liability and quantum stemming from a pedestrian/motor vehicle collision at a busy downtown Toronto intersection. Despite catastrophic injuries being alleged by the Plaintiff, including significant claims for pain and suffering and future treatment costs, they were able to reduce the damages claim based on an apportionment of liability. Further, they were successful in arguing that the Plaintiff's alleged catastrophic injuries were minor in nature and did not meet the criteria of being a permanent serious impairment of an important physical, mental or psychological function, as defined under the Insurance Act, R.S.O. 1990, c. I.8. As a result, the Plaintiff received no award for damages.

We’re incredibly proud of Jason and Brandon for their outstanding work throughout the trial, and grateful to our Toronto and Vancouver teams for the collaboration and support that helped achieve this result.

For BC landlords, aging buildings and strict rent caps can create a difficult funding gap.

ARI-Cs can help recover certain major capital costs—but only when strict eligibility and evidentiary requirements are met.

A recent RTB decision highlights the importance of timing, documentation, maintenance records, and expert evidence.
