Ian Gauthier Wins Sentence Appeal

Our client had taken responsibility for his actions by pleading guilty in Richmond Provincial Court where he was granted a conditional discharge. Upon being threatened and taunted by his roommate, our client kicked in the door to the roommate’s doo=r and held a meat cleaver to his throat. The Crown appealed sentence. At the sentence appeal , Mr. Gauthier argued thatthe sentencing judge had properly considered all the aggravating and mitigating factors and made no errors of law in granting the discharge. The Supreme Court found that the sentence was fit and dismissed the appeal.

"It creates a scenario where British Columbians may be forced to go to court to prove they aren't criminals, and in our view that's simply unconstitutional," said Vibert Jack, litigation director for the B.C. Civil Liberties Association.

The B.C. government has introduced legislation that will expand the use of the Civil Forfeiture Act to go after proceeds of laundered money in the province. The amendments to the act include the creation of unexplained wealth orders.
