This morning, the Supreme Court of Canada dismissed an application by the plaintiff, Barbara De Angelis, for leave to appeal from lower court decisions dismissing Ms. De Angelis’s $30 million claim against her elderly aunt Annie Siermy. In litigation commenced in 2017, Ms. De Angelis alleged that Annie had contracted to leave her the bulk of Annie’s Estate. During a 19-day trial (https://canlii.ca/t/jlpdb) the Farris team of Robert Anderson K.C., Mike Wagner and Kevin Smith successfully argued that there was never any contract, with the Court agreeing that Ms. De Angelis had forged the only documentary evidence of that contract. The B.C. Court of Appeal upheld the decision (https://canlii.ca/t/jt8kz). Ms. De Angelis’s claims in unjust enrichment were also dismissed.

The Supreme Court of Canada’s dismissal of the application for leave, with costs payable to Annie and J&A, concludes this seven-year litigation odyssey. Farris extends its heartful gratitude to Annie for her continued trust and confidence in her legal team, as well as to the family members who stood by her during these years, including and especially Annie’s niece and J&A director Anne Escott. We would be remiss also if we did not take this opportunity to honour the memories of the dearly departed Mary Scott (Annie’s sister and Anne’s mother) and Greg Scott (Mary’s son, Anne’s brother and Annie’s nephew).

Farris Partner Yun Li-Reilly and Associate Counsel Stacey Silber, recently obtained a rare declaration of waiver of privilege in favour of our client, Mr. S, in a family law dispute. Our client’s former spouse, Ms. S, was seeking to amend her pleadings to withdraw certain admissions and make inflammatory allegations against Mr. S. In her affidavit filed in support of the application, Ms. S attached certain email communications with her former counsel, along with an assertion that she was not waiving privilege generally and stated that she had included those emails only to show that the errors in her pleadings were the result of inadvertent oversights. Ms. Li-Reilly and Ms. Silber successfully argued that Ms. S was not allowed to “cherry pick” to refer to only those parts of her communications that favoured her position and, despite her sworn statement to the contrary, she had in fact waived solicitor-client privilege by her actions and disclosures. Mrs. S’s former lawyers were ordered to provide Mr. S with all communications in their file related to the areas in issue.

Farris Partners, Todd R. Bell and Nikki Charlton, recently co-chaired (along with Morag MacLeod K.C.) the 14th Biennial Family Law Conference. At this two-day course hosted by the Continuing Legal Education Society of BC, lawyers, judges and experts discussed significant issues for family law practitioners, and delegates had the opportunity to review and discuss the latest family law developments and trends. In addition to co-chairing, Todd presented on the topic of changes to property law legislation. Farris Associate, Wayne Fernandes, also presented to the group, covering interesting and important developments in case law.

Todd R. Bell is a Partner in Farris’ Family Law group. His practice focuses on the division of high net-worth assets and all manner of parenting and custody litigation. He is a highly skilled litigator and trial lawyer with wide-ranging experience spanning all levels of court in B.C.

The article discusses BC’s reputation as a plaintiff-friendly jurisdiction for bringing class action proceedings, some of the evidentiary and other considerations involved in securing certification, and how the legislation interacts with other key statutes.

Nick Hooge is a Partner in Farris’ litigation group. After a tutorial on the different methods of throwing and how to avoid axe-idents, participants broke into two teams: the older group of Geriaxetrics vs. the fresh-faced Comebaxe Kids. Fairmont Hot Springs Resort Ltd. operates a year-round vacation destination situated in the Rocky Mountains of British Columbia and features pools fed by the largest natural hot springs in Canada. On June 1st, 2023, Puratos Canada completed its acquisition of Foley’s Chocolates, a leading North American chocolate supplier to industrial manufacturers, bakery and food services distributors, and numerous top brands. With this acquisition, Puratos Canada becomes one of the largest chocolate producers in the country.

Puratos Canada is a subsidiary of Puratos NV, an international group which provides a range of confectionary products to artisans, industry retailers and food service customers in the bakery, patisserie and chocolate sectors worldwide.

Foley’s Chocolates has been creating premium cocoa-based compound, ingredients and other pure chocolate products in Richmond, B.C. for over 40 years. Brockmann’s Chocolate, a subsidiary of Foley’s which produces branded chocolate product lines including truffles and clusters, was also acquired by Puratos Canada.

Farris Partner, Nicholas Hooge, recently co-chaired The Advocates’ Society’s “Examining and Cross-Examining Experts” program. This popular skills-building course brought together experienced trial lawyers and judges to explore practical issues relating to expert evidence and offer winning strategies on how to choose, use, prepare, examine and challenge expert witnesses. The session also included a hands-on skills workshop where participants had the opportunity to practise and refine their examination and cross-examination skills.

Nick Hooge is a Partner in Farris’ Litigation group, and has appeared in all levels of courts in British Columbia, as well as in the Federal Court of Canada, the Federal Court of Appeal, the Supreme Court of Canada and a variety of administrative tribunals. Nick has experience in a wide range of complex civil and commercial matters, with particular expertise in public utilities regulation and in class actions matters. In the latter area, he has regularly acted as defence counsel in class action proceedings involving securities law, competition law and consumer protection claims.

Mental well-being is a crucial component of overall health. This week marks Mental Health Week, and while it’s important to dedicate time to highlight the significance of mental health in our personal and professional lives, we recognize this can’t be just a “one week a year” endeavour. For the first quarter of 2022, Farris lawyers, students and staff took part in a “Wellness Challenge” designed to encourage our team to incorporate healthy behaviours into our daily lives on an ongoing basis. Supplemented by weekly seminars on elements of wellness like nutrition, sleep hygiene, financial wellness and mindfulness, the challenge aimed to promote both physical and emotional health with financial incentives. Participants collected points for behaviours like meditation; increasing connections with loved ones and colleagues; acts of gratitude and generosity; physical activity; budgeting; and healthy eating. Awards were given to both the top overall point earners as well as those with the biggest changes from start to finish. Today we wrapped up over a delicious healthy lunch spent connecting with new friends across the firm – a great way to kick off the week and carry these new positive habits into the days and months ahead.

The Canadian Bar Association’s B.C. Family Law Subsection featured Farris associate, Amanda Winters, as a speaker at their recent monthly meeting on April 26, 2022. Amanda presented on the topic of Entitlement to Spousal Support to over 100 subsection members, focusing on entitlement for men, and providing attendees with an update on recent cases of note. Amanda’s practice focuses on family and estate litigation, and she has a particular interest in cases where those areas of law intersect. Her family cases involve a wide range of issues, including not only entitlement to spousal support, but also complex property issues involving trusts and companies, among other things.

You already know their prowess for running a file or a trial, but did you know that the Farris team also runs races? Last weekend, after a two-year COVID hiatus, Farris lawyers, students and friends took to the streets to participate in the annual Vancouver Sun Run, Canada’s largest 10K road race. The Farris team placed 2nd in the law firm category, and 5th in the Legal & Accounting division, with Partner Kevin Smith placing 115th overall amongst over 18,500 runners, with an impressive time of 36:54. Clearly an auspicious day when the official race shirts were a classic Farris green and the sun even made an appearance!

Farris would also like to extend our heartfelt congratulations to the Matthews family and all the members of the “Run Like the Spliz” team, the largest friends and family team to join the event, running in honour and memory of Elizabeth “Spliz” Matthews, sister of Farris Partner Jamie Matthews and daughter of retired Partner Hugh Matthews.
