At Arora Zbar LLP, the start-up mentality means two things: agile development of new systems; and innovating solutions for pain points. While the legal industry sometimes resists efficient tools because of the reduced billed hours, we’re committed to adopting, or even creating these tools. Arora Zbar LLP applies agile development methodology, meaning we have the confidence in our ability to adapt new technology to improve efficiency. For example, we manage the firm using Asana, a project management tool designed for software development, which we customized for the practice of law. The customization is ongoing, but Asana already facilitates team collaboration, greatly reducing our need for emails and phone calls among team members. We find and fix pain points. For instance, we noticed that clients, real estate agents, and mortgage brokers lacked easy access to the closing costs associated with a home purchase. So we designed and built www.pricemyconveyance.com, a residential real estate closing cost calculator to provide clients and real estate professionals a better understanding of the total cost of a new home. Arora Zbar LLP is always learning to create better ways of providing quality and efficient legal services to our clients.

Think Before You Text: A Real Estate Lesson 💡

Realtors, buyers, and sellers – did you know a single text message could cost you a deal or even lead to legal action?

Here’s the truth: After subject removal, contracts of purchase and sale are legally binding. Any message implying the deal might not close could trigger anticipatory breach – a legal doctrine with serious consequences, including forfeiture of deposit, or a lawsuit!.

📢 STORY TIME...

In 2020, the seller, Sally, purchased a Vancouver apartment that featured in-suite laundry. She lived there for several years before deciding to sell, listing the property with the same realtor who had originally represented her on the purchase. The MLS listing, consistent with the original sale, advertised the unit as having in-suite laundry.

Listing, showings, offer, and subject removal proceeded as normal, everything seemed fine until about 2 weeks before closing when I get a WhatsApp message (yes, realtors, if we're closing a deal together you can WhatsApp me to solve problems) from the listing agent, on behalf of my client, the seller, saying the strata board has a problem with her in-suite laundry.

Despite the 2020 MLS listing showing in-suite laundry, they had now taken issue with it, and by closing day had issued a formal demand to have the washing machine either removed, or approved through an onerous and complex process involving an engineer’s report and strata approval. I had sympathy for the buyers who were about to take possession then immediately go to war with their strata.

While we're trying to sort the situation out, the buyer's agent does something which has a technical legal term - it’s called "incredibly stupid." He texts the listing agent saying "if the washing machine has to be removed, the buyers are prepared to withdraw the offer."

A Good Faith Nightmare: How a missed inspection cost $24,000! 😱

Serving a 2-month (now 3-month) notice for vacant possession? Be careful!

A single-family home in Surrey was purchased with no inspection, and the new owners served a 2-month notice for vacant possession. After discovering asbestos during minor renovations, the house had to be torn down. The former tenant submitted just ONE photo as evidence and was awarded 12 months' compensation (~$24,000). The arbitrator ruled that the lack of an inspection was incompatible with good faith to occupy the home. The owners could have served a 4-month notice for demolition, avoiding the penalty.

Ravneet Arora the firm’s dispute resolution practice. Ravneet has represented clients before all levels of court in British Columbia, being the Provincial, Supreme, and Court of Appeal. In addition, Ravneet has represented clients before administrative tribunals, such as the British Columbia Securities Commission and the Financial Institutions Commission. In Ravneet’s view, real lawyers go to court; probably because he watched too many TV shows about lawyers. Fortunately, during his third year at Thompson Rivers University Faculty of Law, Ravneet finished as the top oralist in his division at the B.C. Law Schools Appeal Moot, solidifying his interest in litigation in real life. Ravneet’s core skill set is advocacy, both written and oral. Eli advises entrepreneurs and businesses regarding contracts, corporate governance, and risk management. In addition, Eli represents clients in strata and residential tenancy disputes. In one word, Eli is best described as a “doer”, because he gets things done. As a recent example, Eli drove an hour each way to the business premises of one of his clients on New Year’s Eve 2021 to ensure that the client’s asset purchase transaction closed smoothly. For Eli, any day is a business day if there’s business to be done. Eli and his wife live in Kitsilano. He enjoys baking, cycling, yoga, and travelling.
