Your partner's eligibility for a refund depends on whether you are "spouses" as defined in section 29 of the Family Law Act.

If you are not spouses, then your partner may claim a refund based on his/her interest acquired in the home. If you are spouses, your partner may claim a refund up to the maximum, as long as you did not own a home while you were each other's spouse. If you did own the home while you were each other's spouse, then your partner does not qualify for a refund even if you did not live in the house together.

The HST New Housing Rebate is limited to owner occupants of a new home or new condominium and the HST New Residential Rental Property Rebate is available to those buying a new home or new condominium as an investment. Not everyone buying a new home or new condominium with owner-occupancy in mind for themselves (or a relation) will qualify for the Federal and Ontario rebates. If an individual buys a brand-new cottage, ski chalet, vacation condominium or recreational property and he or she already owns a primary place of residence elsewhere, the 13% HST will be payable on the full purchase price of the second property with no rebates.

Generally, HST is not applicable on the sale price of used residential housing where a dwelling is located on the property. Vacant land may be subject to HST if owned by a corporation as opposed to an individual, who could claim the personal use exemption and not be subject to HST. The sale of newly constructed condominium units, houses or substantially renovated houses with major additions, and relocated houses is subject to HST, which is often included in the purchase price, subject to the applicable rebate. The builder will require the rebate to be assigned to it on closing.

Yes, you are required to submit your claim within 10 days of the date of the incident. When making a claim against the City for pothole damages it’s important to note that the City will not be responsible for your property damage if it has met the Provincial “Minimum Maintenance Standards for Highways in the City of Toronto” (MMS).

The MMS comprises a series of standards for various aspects of road maintenance (patrolling, salting, clearing snow and pothole repair) which vary, depending on the speed limit and traffic volume on a particular roadway in accordance with these standards:

- Potholes in higher speed roads and high-volume roads are repaired more quickly than ones on side streets
- On the busiest roads, the City repairs potholes in four days from the date they are reported
- On side streets, the City has 30 days to repair potholes

The City identifies potholes through regular patrols and reports made by the public to Please note by reporting a pothole online to 311 you are not submitting a claim.

Injured parties of automobile accidents continue to be penalized in Ontario. Effective January 1, 2022, the Statutory Deductible for pain and suffering damages from automobile accidents jumps to $41,503.50 in 2022.

That means, the insurance company for the at fault party gets to keep the first $41,503.50 of your damages for pain and suffering!

There is a monetary threshold that damages assessed at a certain level will not be subject to the deductible. That monetary threshold is $138,343.86 for 2022. In other words if your damages are assessed at $140,000.00, you would get 100% of your pain and suffering damages – $140,000.00. However, if your damages are assessed at $135,000.00, the deductible is applied, which means you would get $135,000.00 less $41,503.50, for a net damage award of $93,496.50.

The deductibles and the monetary thresholds continue to increase annually. Injured plaintiffs are not responsible for the delays in the civil justice system and are the ones who will continue to suffer, while the insurers reap the benefits.

In areas where property owners have scenic views, like cities and towns near the water, a view ordinance is often in place that may protect your view. These ordinances seldom include other types of obstructions like buildings, though.

Be sure to check your local view ordinance for any of the following limitations:

Fence height limitations: Shorter than six feet high in back yards and three or four feet high in front yards.

Tree limitations: Specific species of trees, trees that are a certain distance away from you, and trees owned by the city may be exempt

Zoning limitations: Zoning laws regulate the size, location, and uses of buildings. Usually, single-family homes are not allowed to exceed thirty or thirty-five feet in height.

Condominium Rules: Many condominiums have a set of covenants, conditions, and restrictions that regulate what their residents may do with their property.

Balconies are often neglected in the winter, since they are rarely used. Accumulated snow can weigh them down, sometimes damaging their integrity and surface. Because of this, some condo and apartment complexes mandate their residents remove snow from their balconies. However safety should be the #1 consideration when removing snow from your balcony and you should check with building management.

Please consider the below steps for safe snow removal:

Step 1
Examine the area under your balcony. If there is a sidewalk or parking lot, you should not throw the snow over the balcony unless you plan to remove the snow from the ground as well.

Step 2
Shovel just a little bit of snow at a time, checking first to be sure no one is in the way. If you are in a high traffic area, or end up hitting the balconies underneath, this is not the best option for you. If you can safely throw it several feet out from the building into a safe area, then remove the snow from your balcony in this manner. You may also be able to effectively sweep it away.

Step 3
Shovel the snow into 5-gallon buckets or other large containers and dump it in your bathtub to melt with hot water. This is a slow process, but may work well if your circumstances don't allow you to dispose of the snow outside.

Step 4
Melt the snow. There are many products sold to melt snow and ice, but read the label carefully to verify it is safe to use on concrete or your balcony material. Alternatively, melt the snow with warm water with a little bit of table salt mixed in -- about 1 tsp. per gallon of water. After melting the snow, improve traction with sand or kitty litter, if necessary. In the spring, sweep up the sand and kitty litter and discard.
