Real West Immigration Business immigration strategy for those buying or building a business in Canada to pursue permanent residence

You prepare the business for review and forget that you are being reviewed too.

The officer is not just asking if the company is sound. They are asking if you can run it. If your background does not point toward the business, that raises doubt, and the doubt lands on you.

A strong business plan does not fix a weak fit. The mismatch gets noticed first.

The real fix is simple. Buy a business your background already makes you credible to run.

Most applicants assume misrepresentation means you lied. It does not.
A finding can come from inconsistencies between your application and prior visa records, documents that do not reconcile, information omitted from an earlier application, or an interview answer that contradicts your file. Intent is not the threshold. The test is whether the misrepresentation could induce an error in the administration of the Act.

Under Section 40 of IRPA, a finding carries a five-year ban from Canada and a permanent record that follows every future application.

Tell the truth. Document everything. Read the application before you sign it.

A genuine business acquisition and one structured for an application leave different fingerprints.

A purchase price that ignores market value raises a question. A seller who is still running the business undercuts your claim of control. An owner who disappears right after closing suggests a deal built for the file rather than the business.

Any one of these can be survivable on its own. Together, they form a pattern, and the pattern is what gets read.

A defensible acquisition looks like what it is. Negotiated at arm's length. Paid at real value. Fully transitioned from the previous owner. Operated by you, in practice and not just on paper.

The strongest acquisitions are the ones that would make sense even if immigration were not part of the picture.

A procedural fairness letter does not mean refused. It means the officer has a specific concern and is giving you one chance to answer it.

The concern is usually precise. A source of funds that is not fully documented. A figure that does not reconcile. A business that does not yet look real on paper.

Most refusals that follow a fairness letter do not come from an unanswerable concern. They come from a rushed or generic reply. The letter tells you exactly where the file is weak. The response has to meet that weakness directly, and it becomes part of the permanent record.

This is one of the most important documents an applicant will ever respond to. It deserves to be treated that way.

Buying the shares gets you the asset. It does not get you the right to work in the company.

Work authorization is a separate decision, on a separate standard, under separate rules. Most buyers never map it before closing, which is how someone ends up holding a business they cannot legally operate.
The asset and the authorization are two different things.

Buying a Canadian business does not give you status. A lot of foreign buyers find this out too late.

Owning the company is one thing. Being the person who actually runs it is another. And the officer only cares about the second one.
So they check the real proof. Who pays the staff? Who controls the bank account? Who makes the decisions day to day?

If someone else in Canada is doing all of that while you live abroad, the file falls apart.

You have to run the business yourself. Owning shares is not enough.

Most foreign entrepreneurs assume Canada evaluates them as one country. In business immigration, much of the decision happens at the provincial level, and each province is solving a different economic problem.

One province prioritizes a sector another has little interest in. One sets a financial threshold another sets much higher. The result is that the same entrepreneur, with the same capital and the same business, can be a strong candidate in one province and an ordinary one in another.

This is why the choice of province is a strategic decision, not a personal one. Where family lives or where the climate appeals can matter for your life in Canada. They do not determine where your application is strongest.

The entrepreneurs who succeed choose the province that fits their profile, rather than forcing the profile to fit a province chosen for the wrong reasons.

Most foreign entrepreneurs believe that showing the money is enough. It is not.

A bank balance shows what you have. It does not show how you earned it. And how you earned it is what matters most.

Capital needs a documented history. Every dollar needs a clear origin. Every transfer needs a path that can be followed. Every gap needs an explanation.

When money appears with no story behind it, the credibility problem starts before anyone has read a single page of the business plan.

Capital is rarely the hard part. The history behind it usually is.

The language test is treated as the hurdle. It isn't. The test proves a level. It establishes that the applicant can communicate at a measured standard. That is one data point.
The business is what gets read against it.

Officers assess whether the proven level is enough to run the company that was bought, in the role that was claimed. Hiring, suppliers, contracts, payroll, the bank. The same level reads differently for a passive investor than for someone operating the business daily.

The score sets the floor. The business decides whether the floor is high enough.

Two foreign entrepreneurs buy the same business in Canada, at the same price. One application is approved. The other is refused.

The purchase price is not what determines the outcome. The capital behind it is.

Officers look at the full financial picture. How much total capital the entrepreneur has. How much is going into the business. How much remains for operating reserves. How much is set aside for the family's settlement. How much depth there is to carry the business through the period the pathway requires.

A file where every available dollar is committed to the purchase reads as fragile. A file with reserves, settlement funds, and visible capital depth reads as credible. Same business. Same price. Two completely different applications.

The purchase price is what the entrepreneur pays. The capital story is what the officer actually reads.
