Understanding when probate is required in British Columbia can save you time, money, and stress during an already difficult period. Here's what you need to know.
โ ๐ช๐๐๐ง ๐๐ฆ ๐ฃ๐ฅ๐ข๐๐๐ง๐?
Probate is the legal process where BC's Supreme Court confirms a will is valid and grants the executor authority to manage the deceased's estate. Once granted, it allows the executor to access and distribute assets like bank accounts, real estate, and investments

Probate is typically needed when:
๐ฅ๐ฒ๐ฎ๐น ๐ฒ๐๐๐ฎ๐๐ฒ is solely owned by the deceased
๐๐ฎ๐ป๐ธ ๐ฎ๐ฐ๐ฐ๐ผ๐๐ป๐๐/๐ถ๐ป๐๐ฒ๐๐๐บ๐ฒ๐ป๐๐ over $25,000-$50,000 (varies by institution)
๐ฆ๐ผ๐น๐ฒ๐น๐ ๐ผ๐๐ป๐ฒ๐ฑ ๐ฎ๐๐๐ฒ๐๐ without designated beneficiaries
๐ฆ๐ต๐ฎ๐ฟ๐ฒ๐ ๐ผ๐ฟ ๐ฏ๐๐๐ถ๐ป๐ฒ๐๐ ๐ถ๐ป๐๐ฒ๐ฟ๐ฒ๐๐๐ held in the deceased's name only
Estates valued over $50,000 generally require probate in British Columbia, though some financial institutions may require it regardless of value

You may NOT need probate if:
โ ๐๐ผ๐ถ๐ป๐๐น๐ ๐ผ๐๐ป๐ฒ๐ฑ ๐ฝ๐ฟ๐ผ๐ฝ๐ฒ๐ฟ๐๐ with right of survivorship (automatically passes to surviving owner)
โ ๐๐ฒ๐๐ถ๐ด๐ป๐ฎ๐๐ฒ๐ฑ ๐ฏ๐ฒ๐ป๐ฒ๐ณ๐ถ๐ฐ๐ถ๐ฎ๐ฟ๐ถ๐ฒ๐ on RRSPs, TFSAs, life insurance, pensions
โ ๐ฆ๐บ๐ฎ๐น๐น ๐ฒ๐๐๐ฎ๐๐ฒ๐ under $25,000 (though some institutions may still require it)
โ ๐๐ผ๐ถ๐ป๐ ๐ฏ๐ฎ๐ป๐ธ ๐ฎ๐ฐ๐ฐ๐ผ๐๐ป๐๐ with true joint ownership
Assets such as joint bank accounts or a home jointly owned with a spouse often pass directly to the surviving owner without probate through the right of survivorship
