Exciting news for developers in British Columbia! The BC Financial Services Authority (BCFSA) has issued an advisory notice regarding the amendments made to Policy Statements 5 and 6. These changes aim to standardize early marketing requirements in the province, providing greater flexibility for developers to obtain financing at an earlier date while maintaining strong consumer protections.

One of the key amendments made to Policy Statement 5 is the clarification of the concept of "approval in principle" regarding building permits. The new standard sets out that "approval in principle" is obtained when a municipal or other government authority has given third reading to a bylaw to zone or rezone the site for the developer’s proposed development. This means that developers may commence early marketing after third reading, providing they still meet the remaining rules and requirements under Policy Statement 5.

Policy Statement 6 has also been amended to clarify what qualifies as a "satisfactory financing commitment." The amendment states that it is a commitment of funds from a lender that is not conditional on the developer entering into a certain number of purchase agreements with purchasers or achieving a certain value of sales.

Overall, these amendments provide greater clarity and flexibility for developers in British Columbia.
