1) Most personal injury claims are frivolous:
In reality, most personal injury cases are valid, based on real injuries caused by someone else's negligence. Lawyers carefully evaluate cases before taking them on, and insurance companies conduct thorough investigations to verify the validity of claims.

2) Only physical injuries are compensated:
Personal injury claims aren't limited to physical harm. They also cover emotional distress, psychological trauma and other non-physical injuries.

3) I'll have to go to court if I have a personal injury case:
Many people believe that all personal injury claims end up in court. In reality, the majority of these cases are resolved through negotiations and settlements. Going to court is usually a last resort when a fair settlement cannot be reached through alternative means.

4) I can sue anytime:
In Ontario, you generally have two years from the date of the accident to file a lawsuit. Slip & fall claims have a 10 or 60 day requirement to provide written notice, depending on whether it's on public sidewalks or private property. After that, you may lose the right to seek compensation. Timely action is key.

Many people make the mistake of assuming they can’t claim compensation after an accident due to various misconceptions. Let’s set the record straight.

1) I can’t claim compensation because I was at fault:
This is false. In Ontario, we have Accident Benefits, also known as no-fault benefits. These benefits help cover medical expenses, lost wages, attendant care and more, regardless of who caused the accident.

2) I can't claim compensation as a passenger, pedestrian, or cyclist because I don’t have my own auto insurance:
This is untrue. As a passenger, pedestrian, or cyclist, you can still claim compensation. You can file an Accident Benefits claim through the insurance policy of any vehicle involved in the accident. You can also sue at-fault parties, even if you're partially at fault.

3) Talking to a lawyer will cost me money:

Whether the fall happens on private or public property, property owners, tenants, and occupiers are responsible for maintaining safe conditions on their premises.

If you slip and fall due to hazardous conditions, they may be liable for your injuries. Hazards could include spills, snow and ice, uneven flooring, worn carpeting, obstacles, poor lighting or inadequate handrails.

In Ontario, for falls on city sidewalks, you have 10 days to provide written notice to the city. For falls on private property, you have 60 days to provide written notice to the property owner or maintenance contractor.

To support your claim, visiting a doctor right away to document your injuries is key. You should also keep evidence such as photographs of the scene, your footwear, and witness contact information. Even if you're partly at fault, it doesn’t necessarily bar your claim. Liability may be shared between you and the property owner, depending on the circumstances.

Compensation for slip and fall claims can cover pain and suffering, medical expenses and lost wages.
