UPDATE: Court of Queen's Bench new Covid-19 Directive

The Saskatchewan Court of Queen's Bench has resumed hearing all civil and family law applications beginning June 1, 2020. All hearings will still be held by phone, but now these hearings are no longer limited to "urgent" matters. That means those of you who have been waiting to have your matter heard in court during Covid-19 are now able to proceed. In order to set a hearing date, the lawyer must submit a request to the Court for a date. These dates may be within a couple of weeks or longer.

Appearance Day Notices may now be scheduled and will be held by phone.

Pre-Trial Conferences will also be taking place during the months of July and August. The Court has set aside a significant number of days on which pre-trial conferences can be held. The presiding judge will determine whether the pre-trial conference is to be held in person or remotely.

The Court of Queen's Bench is only taking urgent and emergency matters right now. If you have a matter that is not urgent or an emergency, there are alternatives to resolving your disputes. Our office offers out of court settlement in the form of mediation, arbitration or collaborative services.

FAMILY LAW and COVID-19

A recent Ontario case, Ribeiro v Wright, 2020 ONSC 1829 (CanLII), addressed the concern of parents who share parenting responsibilities of their children.

In short, the first and foremost rule when deciding parenting of a child is the child's best interest. In some instances that means continuing with co-parenting, and in others it means putting the parenting on hold.
