I'm among a group of law firms and lawyers in our community who are offering "simple" Wills during Free Wills Month in June, for residents of Saskatchewan and Manitoba who are 55+.

The Free Wills are sponsored by several charities. There is no obligation to leave gifts to the charities, though they obviously do hope that will happen, as they all rely on gifts for a large portion of their income.

This is an opportunity to update your Will and at the same time consider leaving a gift in your Will to one or more of a group of wonderful charities.

It has been a pleasure working with the Executive Director, Len Usiskin, and many other board and staff members, like Jacqui Barclay, Sheila Aubichon-Pocha, and Laverne Sjevolt, over the years. Excellent advice - make a Will, to avoid the confusion for your family if you do not have one!

Our local paper recently published (then thankfully retracted) an article on estate planning that perpetuated a common myth about what happens when you don't have a Will.

Contrary to popular belief, if you die without a Will, the government does not automatically "take over" your estate in any way - they do not make decisions about, or confiscate, your property. There is legislation that sets out who inherits from you and who may administer your estate, based on familial relationships.

What does happen though, is confusion and stress for your family, who often need to apply to court to confirm their decision-making authority. You also may not be pleased with the way your estate is divided among your family members, when you had other plans.

For this reason, we will stand by the last line of the retracted piece, which is simply "get a Will!"
