Received an IRCC refusal: When is it worth requesting reconsideration?

🇨🇦 A reconsideration request asks IRCC to revisit a decision that has already been made. It is not an appeal and does not guarantee that IRCC will reopen the application.

However, in certain situations, a reconsideration request may be appropriate.

📌 When may there be grounds for reconsideration?

▪️ The officer made a clear factual error — for example, stated that a document was missing when it had actually been submitted.
▪️ The officer overlooked important evidence that was included in the application, such as financial documents, employment evidence, relationship evidence, or a letter of explanation.
▪️ The officer incorrectly applied the law or program requirements — for example, used the wrong criterion or imposed a requirement that the program does not actually have.
▪️ There was a procedural fairness issue — the decision was based on significant concerns that, in the circumstances, the applicant should have been given an opportunity to address.
▪️ IRCC made an administrative or processing error when handling the application.

📌 When is reconsideration usually a weaker option?

▪️ you simply disagree with the officer’s assessment;
▪️ you now have new evidence that was not included in the original application;
▪️ the applicant’s circumstances have significantly changed;
▪️ you can now provide a stronger explanation for something that should have been addressed in the original application.

In these situations, submitting a new application that addresses the reasons for refusal may be more appropriate.

⚖️ Another important point: reconsideration and judicial review at the Federal Court are two different processes.

With reconsideration, you ask IRCC to revisit its own decision. With judicial review, you ask the Federal Court to review whether the decision was lawful, reasonable, and procedurally fair.

That is why after a refusal, the first step should not automatically be to “apply again.” It is important to understand what led to the negative decision and determine which next step is appropriate for your particular case.

Отримали відмову IRCC: Коли варто просити про перегляд рішення?

🇨🇦 Reconsideration request — це звернення до IRCC із проханням повторно розглянути вже ухвалене рішення. Це не апеляція і не гарантія повторного відкриття справи.

Але в певних ситуаціях такий запит може бути обґрунтованим.

📌 Коли є підстави розглядати reconsideration?

▪️ Офіцер припустився очевидної фактичної помилки, наприклад, зазначив, що документа не було, хоча його вже подали.

▪️ Не врахував важливий доказ, який був у заяві: фінансові документи, підтвердження роботи, стосунків, пояснювальний лист тощо.

▪️ Неправильно застосував закон або вимоги програми, наприклад, використав неправильний критерій або вимагав те, чого правила програми не передбачають.

▪️ Виникла проблема з procedural fairness — рішення ґрунтувалося на суттєвих застереженнях, на які заявник за конкретних обставин мав отримати можливість відповісти.

▪️ IRCC допустило адміністративну або технічну помилку під час опрацювання заяви.

📌 А коли reconsideration зазвичай є слабшим варіантом?

▪️ ви просто не погоджуєтеся з оцінкою офіцера;
▪️ після відмови з’явилися нові докази, яких не було в початковій заяві;
▪️ обставини заявника суттєво змінилися;
▪️ тепер ви можете краще пояснити те, що варто було пояснити ще під час подання заяви.

У таких випадках доцільніше підготувати нову заяву з урахуванням причин відмови.

⚖️ І ще один важливий момент: reconsideration та judicial review у Federal Court — це різні процедури.

У першому випадку ви просите IRCC самостійно переглянути своє рішення. У другому — просите Federal Court перевірити, чи було рішення законним, обґрунтованим і процедурно справедливим.

Тому після відмови важливо не просто вирішити «подамо ще раз», а спочатку визначити, що саме стало причиною негативного рішення і який наступний крок підходить саме у вашій ситуації.

📌 We are wrapping up our series of posts on the SINP changes.

In previous posts, we covered various aspects of the updated SINP rules, including Certificate of Registration (COR) requirements, restrictions affecting certain work permit holders and PGWP holders, and who can access the 750 nomination spaces reserved by the SINP.

Today, we are looking at the options that remain available to graduates who studied outside Saskatchewan.

📌 SINP options for out-of-province students

Following the changes, graduates who studied in another Canadian province but are now working in Saskatchewan can no longer apply through the Saskatchewan Experience pathways based solely on their employment in the province.

This is an important change for PGWP holders who moved to Saskatchewan after completing their studies elsewhere in Canada.

However, these candidates may still have other SINP options if they meet the applicable requirements.

Potential pathways may include:

▪️ International Skilled Worker: Employment Offer;
▪️ Health Talent Pathway;
▪️ Agriculture Talent Pathway;
▪️ Innovation and Tech Talent Pathway.

For graduates from other provinces, it is therefore important not to rely on the previous rules and to review the current SINP requirements before applying.

📌 Якщо ви навчалися не в Саскачевані: які варіанти SINP залишаються?

Після змін випускники, які навчалися в іншій провінції Канади, але працюють у Саскачевані, більше не можуть подаватися через Saskatchewan Experience pathways лише на підставі роботи в провінції.

Це важлива зміна для власників PGWP, які переїхали до Саскачевану після навчання в іншій провінції.

Водночас такі кандидати можуть розглядати інші напрямки SINP, якщо вони відповідають вимогам.

Зокрема, потенційно доступними можуть бути:

Чотири відбори за чотири дні — що змінилося в Express Entry

🇨🇦 Після чотирьох відборів поспіль, які IRCC провело з 4 до 7 серпня, загальна кількість запрошень у Express Entry у 2026 році досягла 113423 ITA. Лише за ці 4 дні було видано 8807 запрошень.

Але значно цікавіше подивитися не на окремі результати, а на те, як зараз розподіляються відбори та ITA між основними категоріями.

📌 Provincial Nominee Program — 15 відборів
У 2026 році IRCC вже провело 15 PNP-відборів — це 32,6% від усіх 46 вибірок Express Entry. При цьому через них видано лише 6597 ITA, або 5,8% від загальної кількості.

Останній PNP-відбір 4 серпня також показав зростання CRS: 768 проти 744 у попередньому раунді 20 липня, тобто +24 бали. Кількість ITA при цьому майже не змінилася — 507 проти 511.

Фактично PNP залишається найпоширенішим типом відбору у 2026 році, але за кількістю запрошених кандидатів його частка невелика.

📌 Canadian Experience Class — 13 відборів
CEC становить 28,3% усіх відборів цього року, але на цю категорію припадає вже 48250 ITA — 42,5% від усіх запрошень у 2026 році.

5 серпня CRS залишився на рівні попереднього відбору — 516. Водночас після двох поспіль раундів по 2000 ITA IRCC збільшило обсяг нового відбору до 3000.

Тобто за кількістю проведених раундів CEC поступається PNP, але за кількістю ITA різниця величезна: 48250 проти 6597.

📌 French-language proficiency — 9 відборів
Відбори для франкофонів становлять лише 19,6% від усіх раундів Express Entry у 2026 році, але через них уже видано 45500 ITA — 40,1% усіх запрошень.

6 серпня CRS знизився до 391 — це найнижчий показник серед усіх відборів категорії у 2026 році.

Особливо показове співвідношення: 9 франкомовних відборів дали майже стільки ж ITA, скільки 13 CEC-відборів — 45500 проти 48250.

📌 Transport occupations — повернення після перерви
7 серпня IRCC провело перший Transport draw у 2026 році та перший відбір цієї категорії з березня 2024 року — 300 ITA при CRS 470.

Але повернулася вже інша категорія "Transport". У ній залишилося лише 4 групи NOC, три з яких безпосередньо пов'язані з авіацією.

Водії вантажівок до нового переліку не увійшли. Тобто, повернення Transport саме по собі ще не означає повернення широких можливостей для кандидатів транспортної галузі, які існували в попередній версії категорії.

📊 CEC + French-language proficiency + PNP разом — це 37 із 46 проведених відборів, або 80,4%. На ці 3 напрямки припадає 100347 ITA — 88,5% усіх запрошень, виданих цього року.
При цьому дві категорії — CEC та French-language proficiency — разом дали 93750 ITA, тобто 82,7% від загальної кількості.

Саме ці цифри зараз найкраще показують, де у 2026 році зосереджений основний обсяг запрошень Express Entry.

Four Draws in Four Days — What Changed in Express Entry

🇨🇦 Following four consecutive draws conducted by IRCC from August 4 to 7, the total number of Express Entry invitations issued in 2026 reached 113,423 ITAs. In just four days, 8,807 invitations were issued.

But rather than looking at each result separately, it is more interesting to examine how draws and ITAs are currently distributed across the main categories.

📌 Provincial Nominee Program — 15 draws
In 2026, IRCC has already conducted 15 PNP draws — 32.6% of all 46 Express Entry rounds. However, these draws have issued only 6,597 ITAs, representing 5.8% of the total.

The latest PNP draw on August 4 also saw the CRS cut-off increase to 768 from 744 in the previous round on July 20 — a rise of 24 points. The number of ITAs remained almost unchanged, at 507 compared with 511.

PNP therefore remains the most frequently held type of Express Entry draw in 2026, but its share of the total number of invited candidates remains relatively small.

📌 Canadian Experience Class — 13 draws
CEC accounts for 28.3% of all draws held this year, but the category has already produced 48,250 ITAs — 42.5% of all invitations issued in 2026.

On August 5, the CRS cut-off remained unchanged from the previous draw at 516. At the same time, after two consecutive rounds of 2,000 ITAs, IRCC increased the latest draw to 3,000 invitations.

CEC therefore trails PNP in the number of rounds conducted, but the difference in ITAs is substantial: 48,250 compared with 6,597.

📌 French-language proficiency — 9 draws
French-language proficiency draws account for only 19.6% of all Express Entry rounds in 2026, yet they have already produced 45,500 ITAs — 40.1% of all invitations.

On August 6, the CRS cut-off dropped to 391 — the lowest score recorded for this category in 2026.

The comparison is particularly notable: just 9 French-language proficiency draws have produced almost as many ITAs as 13 CEC draws — 45,500 compared with 48,250.

📌 Transport occupations — return after a long pause
On August 7, IRCC conducted the first Transport draw of 2026 and the first draw for this category since March 2024, issuing 300 ITAs with a CRS cut-off of 470.

However, Transport returned as a substantially different category. Only four NOC groups remain on the current list, and three of them are directly related to aviation.

Transport truck drivers are not included in the new list. Therefore, the return of Transport does not mean a return to the broader range of opportunities previously available to candidates working across the transportation sector.

📊 Together, CEC, French-language proficiency and PNP account for 37 of the 46 draws conducted in 2026 — 80.4% of all rounds. These three streams have produced 100,347 ITAs, representing 88.5% of all invitations issued this year.

CEC and French-language proficiency alone account for 93,750 ITAs — 82.7% of the 2026 total.

These figures provide a much clearer picture of where the majority of Express Entry invitations are concentrated in 2026.

IRCC continues working to restore the Application Status Tracker.

🇨🇦 The tracker has been unavailable since May 14, 2026. According to IRCC-confirmed information, the service was taken offline after outdated information and system security concerns were identified. It will remain unavailable while the department corrects the data and implements additional safeguards.

📌 What do we know so far?
▪️ no date has been announced for when the tracker will return;
▪️ IRCC says restoring the service remains a priority;
▪️ application processing continues as usual.

📌 How can applicants check their status?
While the Application Status Tracker remains unavailable, applicants can continue checking updates through their IRCC Secure Account.

We'll share an update as soon as IRCC announces that the tracker is back online.

In our previous publications, we explored the key changes to the Saskatchewan Immigrant Nominee Program (SINP), including the Certificate of Registration (COR) requirements, restrictions affecting certain types of work permits, and the limitations that apply to Post-Graduation Work Permit (PGWP) holders. Today, we take a closer look at who is eligible for the 750 nomination spaces reserved by the SINP for graduates of Saskatchewan educational institutions.

📌 Who qualifies for the 750 reserved SINP spaces?

The Saskatchewan Immigrant Nominee Program (SINP) has reserved 750 nomination spaces for graduates who completed their studies in Saskatchewan and are working in priority sectors.

These priority sectors include:
▪️ Health care;
▪️ Agriculture;
▪️ Skilled trades;
▪️ Energy;
▪️ Mining;
▪️ Manufacturing;
▪️ Technology.

The reserved spaces are available to graduates of any designated learning institution (DLI) in Saskatchewan, including universities, polytechnic institutions, and regional colleges.

Graduates employed outside these priority sectors may still be eligible to apply to the SINP if they meet the program requirements. However, they cannot access these 750 reserved spaces.

For international students planning to immigrate through the SINP, both their field of study and future employment sector may play an important role in their immigration strategy.
