There is a lot to think about when you are separating. In addition to the "legal stuff" here are some other matters you should turn your mind to:
1. Check your Will and beneficiary designations;
2. Update or consult with CRA regarding your marital status for tax purposes;
3. Do you need to close joint bank accounts or redirect bill payments or direct deposits;
4. Do you need to review of update insurance policies;
5. Do you need to review medical benefits or obtain new ones?

Shannon Proudfoot: We've done what we were asked to do, at great cost to our wellbeing and that of our young kids. And still, the pandemic cruelty continues.

Answer:  Probably not.

One of the main reasons why someone usually wants to add their kids to title is to avoid having to pay probate fees on the property on their death. The reality is that in my most provinces, probate fees are minimal.

The savings experienced from avoiding probate are often offset by the potential disadvantages, including:

- the property is now partly owned by your child and is available to their creditors, and could form part of family property subject to division on a divorce/separation

- If you want to sell/mortgage/rent the house, you will need their permission.

- When you sell the house, it will not be considered to be their principal residence - arguably they should be reporting the sale on their tax return.

Do you know what your income tax liability will be on death? If so, do you know how you will pay it?

Estate planning is about more than just drafting a quick Will - it does not have to be complicated, but if you fail to plan, you can leave a huge mess for everyone to clean up after your death.
