Dealing with a property sale where the seller is facing collections or foreclosure? It’s a tough situation, but navigating it smoothly comes down to moving quickly and staying organized.
For this week’s Monday Morning Real Estate Law, here are 5 critical steps to protect your client and keep the transaction on track:
📋 1. Gather the Paperwork Early
Collect all demand letters and court documents immediately. We need to know exactly where your client stands in the legal process to effectively coordinate with opposing counsel.
⏳ 2. Request Payouts Well Ahead of Time
Foreclosure and collection payouts aren’t like standard sales—they often go through legal counsel rather than directly from the lender. Requesting these early avoids last-minute closing delays.
💰 3. Dig into the Equity & Fees
Review exactly what equity is left after commissions, legal fees, and extra lender charges. If equity is tight, we need time to build a strategy with creditors or mortgage insurers.
🗣️ 4. Keep Communication Open
Avoiding the lender, realtor, or lawyer only spikes costs and creates roadblocks. Clear, proactive communication keeps options on the table.
🛠️ 5. Maintain the Property
Your client doesn’t need to take on major renovations, but skipping regular maintenance can rapidly degrade the home’s value, making a tough situation even harder.

What happens if a hail storm hits right before closing? ⛈️🏘️
Under Clause 7.5 of the standard SK real estate contract, a deal automatically terminates if a property suffers “substantial damage” before the completion date—unless the damage is repaired or both sides agree to a solution in writing.
Because emergency roof repairs take time, you will likely need a written amendment (like a lawyer’s trust holdback or a price reduction) to save the deal.
But don’t do it alone! If you change the terms or have active damage on the home, your mortgage lender needs to be in the loop. Always consult your mortgage broker and your real estate lawyer before signing an amendment.
Don’t let a storm freeze your transaction in legal limbo. Stay proactive and communicate!

🏠 Monday Morning Real Estate: The “Middle Child” of Your Transaction
Ever think about home insurance during a real estate deal? 🛋️ Probably not until the last minute—which is exactly why I call it the **middle child** of the real estate transaction. It does all the heavy lifting, but nobody really likes to think about it!
As a middle child myself, I can say that safely. 😉
But here’s why it’s critical: your lender **will** require it to be fully in place before they fund your mortgage. To keep your closing on track, make sure you check these four boxes:
📝 1. Get a Binder Letter, Not a Quote
A screenshot of a payment or a basic quote won’t cut it. Lenders need a formal **insurance binder** or **confirmation of coverage** showing that the policy is officially active.
📅 2. Check the Effective Date
The policy must be active on your **possession date**. Lenders will reject it if the start date is even a day late.
🏢 3. Verify the "Loss “ayee" Deta”ls
Your mortgage lender must be listed correctly as the loss payee. The address needs to be exact—down to the last character—or the lender might send us back to the drawing board to get it corrected.

💡 *Pro-tip: Have your insurance broker reach out directly to your legal team to ensure everything matches perfectly.*

🏢 4. Condos Are a Different Beast
If you're buyin’ a condo, the corporation usually covers the main structure, but you will still need a **unit owner policy** to protect your personal improvements, liability, and deductibles.
