We are very pleased to announce that Monica L. Niederle has joined our firm as an Associate, effective as of February 2nd, 2026!

Monica is an experienced lawyer with over 20 years of practice focused on corporate, commercial, real estate and estate planning matters. She advises entrepreneurs, businesses, and individuals on corporate and entrepreneurial law, commercial transactions, mergers and acquisitions, corporate reorganizations, franchise law, business purchases and sales, banking and corporate finance, commercial and residential real estate, leasing, and wills and estate planning. Monica’s background includes working at national law firms as well as in-house counsel for a national franchisor, providing practical, business-focused legal advice.

Monica believes in giving back to the Red Deer and Central Alberta community and enjoys presenting pro bono on various legal topics to groups and organizations, and welcomes any and all invitations to do so.
Outside of work, Monica’s free time is spent with her husband and their two children, volunteering at her children’s schools and on their sports teams, and travelling around the world.

Probate Planning - Estate Tax & Trust Planning Options: Conclusion

Clearance certificates, how do they work?

Before distributing the estate to the beneficiaries, the Income Tax Act requires that the legal representative of the estate acquire a clearance certificate from CRA. Failure to do so will cause the legal representative to be personally liable for any amounts owed by the deceased. A clearance certificate applies to the final tax return as well as a final T3 trust return (if applicable).

Once the clearance certificate is issued, CRA considers the chosen date as the actual date of distribution for tax purposes. It also regards the estate or trust representative as holding the properties for the beneficiaries since this date. Income earned by the estate is then reported by beneficiaries from this point onwards.
