Does a CAO qualify for overtime pay? A recent Manitoba Labour Board decision provides clear guidance on the overtime exemptions for management functions and high-earning employees with control over their hours.

The Board ruled the CAO was exempt because their duties were primarily management functions (supervising staff,budgeting) and their earnings exceeded the industrial wage average.

Municipalities: While the exemption stands, it's open to you to authorize specific overtime. Consult your legal counsel to ensure your employment agreements are up-to-date and protect both parties.
