The deadline to request a review of an applicable LTB order has been shortened from 30 days to 15 days. This means landlords and tenants should act promptly after receiving an order.

A review is not available simply because someone disagrees with the result. However, circumstances that may be relevant can include:

• A serious error in the order or hearing process
• Missing a hearing through no fault of your own
• Other circumstances recognized under the applicable LTB rules

If you believe an order contains a serious error or you missed the hearing for reasons outside your control, do not delay. The review window may be short, and procedural requirements matter.

Need to know: An N12 notice is not an automatic eviction.

In Ontario, a landlord may serve an N12 notice when the rental unit is genuinely required for the landlord, an immediate family member, or a caregiver. However, the landlord must still:

• Follow the required notice and application process
• Provide the required compensation or an acceptable alternative unit
• Act in good faith and genuinely intend to occupy the unit
• Obtain an order from the Landlord and Tenant Board before an eviction can proceed

The landlord’s previous eviction applications or relevant history may also need to be disclosed. Inconsistencies, incomplete information, or evidence that the stated reason is not genuine may be relevant to the Board’s decision.

Tenants should carefully review an N12 and respond to the LTB process. Landlords should maintain clear records supporting the intended use of the unit.
