How does covid-19 affect the family court system?

As you may have heard, Ontario courts have significantly changed the way they are operating during this trying time. What does this mean for the clients?

1. Clerk hours are reduced to 10-12 and 2-4 from Monday through Friday.

2. Only emergency cases will be brought before a judge.

3. All court dates scheduled during March have been moved to June 2 2020 at 10am. All court dates scheduled during April have been moved to June 3 2020 at 10am. All court dates scheduled in May have been moved to June 4 2020 at 10am. All trials scheduled have been moved to June 5 2020 at 10am.

4. No court dates, including short motions, long motions, conferences or first appearances, will be scheduled until further notice.

5. It is recommended that all documents be filed online to avoid going to the courthouse.

6. Offsite mediation services are still offered and can be accommodated through a video conference where necessary.

7. Mandatory Information Programs will now be completed through a video conference.

What is litigation?

Litigation is the process by which the two parties involved take legal action and resolve their issues via the court system. Going to court can be a complicated process and take a lot of time. It can be stressful and expensive, but it is sometimes necessary to decide your issues. There are MANY misconceptions regarding legal rights and responsibilities. We always advise that you speak with a lawyer regarding your individual legal rights and responsibilities!

What is mediation?

Mediation provides an opportunity for separating parents to make informed decisions collaboratively & cooperatively through respectful, non adversarial methods, that are confidential (closed) and take place in an informal setting in the community. The goal is to reach mutually acceptable & sustainable solutions without going to court. The added benefit is that parents often report that they are better prepared to manage their co-parenting differences in the future.

Are mediated settlements legally binding?

Yes! The agreement that is reached is drafted in to a legally binding contract. This contract can be used as a separation agreement (for divorce) and parenting plan.

Hello All!

I am the Information and Referral Coordinator (IRC) for Renfrew County Mediation Services in Pembroke, Ontario. Over time we have noticed an increasing need in our community for additional information pertaining to the family court system and the options that families have when dealing with a separation. We hope that by creating an online forum where individuals can seek out resources, information, or other forms of guidance we can limit the amount of misinformation being presented during such a difficult time!

Along with direct access to the IRC, this page also has several documents and resources that may be helpful in guiding you to make informed decisions.
