Small Claims 101: Big Changes to Access to Justice in Ontario ⚖️

Did you know that the Small Claims Court limit in Ontario has officially increased? As of late 2025, you can now sue for up to $50,000 in Small Claims Court (up from the previous $35,000 limit).

This is a major win for individuals and small businesses looking for a faster, more cost-effective way to resolve legal disputes without the complexity of the Superior Court.

But where do you begin? It starts with the Plaintiff’s Claim.

What exactly is a Plaintiff’s Claim?
Think of this as your "Legal Voice." It is the formal document (Form 7A) that initiates your lawsuit. It tells the court and the defendant:
✅ The Who: Exactly who is being sued and who is suing.
✅ The What: A clear summary of the facts and what went wrong.

A major report just came out showing that Ontario police violated people’s Charter rights — the rights guaranteed u.

We’re Amanda and Jeanette at Just & Fair Legal, and we built this firm because we believe the law should work FOR people — not be used against them. So let’s break this down in plain language.

✅ YOU HAVE THE RIGHT TO A LAWYER THE SECOND YOU’RE ARRESTED.
Not after they ask their questions. Not when it’s convenient for them. Immediately. This was one of the most broken rules in the entire study. If police didn’t tell you this — or didn’t let you call the lawyer you wanted — that matters for your case.

✅ THEY CANNOT SEARCH YOU WITHOUT A GOOD REASON.
Your home. Your car. Your phone. Police need reasonable grounds to search. When they don’t have them and search anyway, courts can throw out EVERYTHING they found — no matter what it was.

✅ IF YOU’RE ARRESTED, YOU SHOULD SEE A BAIL COURT WITHIN 24 HOURS.
Courts have been calling this out for over 20 years. If you or someone you love sat in a cell for days without a bail hearing, that is not normal. That is not okay. And it is legally significant.

This post is for every nurse, paramedic, factory worker, corrections officer, and shift worker who has ever negotiated with themselves at a red light at 7 AM.

I have been you. I spent over 20 years on the front lines — as a paramedic and as an emergency room nurse. I know what that drive home feels like. And I know, both clinically and legally, that it is far more dangerous than most people realize.

WHAT IS ACTUALLY HAPPENING IN YOUR BRAIN

You might feel like you are simply tired. But here is what the research tells us:

When you have been awake for 17 to 19 consecutive hours, your driving is as impaired as someone at Ontario's legal blood alcohol limit — and critically, your brain cannot accurately gauge how compromised it is. Most fatigued drivers genuinely believe they are fine. That is not a character flaw. It is a documented neurological consequence of sleep deprivation.

There is also a deeper condition that most shift workers are never told about: Shift Work Disorder. Ottawa Paralegals: We need to stand together.

The news about the Algonquin College paralegal program being cut has been heavy on my mind. As a professor there for 8 years, a teacher for 20, and a licensed paralegal for over 10, I’m not just watching this happen—I’m feeling it along with you.

When Jeanette and I started Just & Fair Legal, we wanted to make a difference. Now, we realize that making a difference starts with making sure our future colleagues are supported. Access to justice in Ontario depends on having paralegals who are ready, confident, and well-trained.
