In our first profile of amazing Canadian women for Women and IP: Accelerating innovation and creativity, we celebrate Canada’s female Nobel laureates:  Donna Strickland-Dykaar, 2018 Physics Nobel Prize winner for her work in chirped pulse amplification and Alice Munro, 2013 Literature Nobel Prize as the “master of the contemporary short story”.  Ms. Strickland-Dykaar is 1 of only 4 women to win the Physics Nobel and her work has many applications including cancer treatments, laser eye surgery and machining smartphone cover glass.  Ms. Munro’s literary genius can capture complex narratives about the intricacies of human relationships and nuances of everyday life into the short story medium.  These distinguished women are leaders in their fields and their achievements have helped shape our world and inspire other and ! 

Dans notre premier profil de femmes canadiennes exceptionnelles pour « Les femmes et la propriété intellectuelle : Accélérer le rythme de l’innovation et de la créativité », nous célébrons les lauréates canadiennes du prix Nobel : Donna Strickland-Dykaar, pionnière de la physique et lauréate du prix Nobel de physique 2018 pour ses travaux sur l'amplification des impulsions modulées et Alice Munro, prix Nobel de littérature 2013 décrite comme "la maîtresse de la nouvelle contemporaine". Mme Strickland-Dykaar est l'une des 4 seules femmes à avoir remporté le prix Nobel de physique et son travail a de nombreuses applications, notamment pour les traitements contre le cancer, la chirurgie oculaire au laser et l'usinage du verre de protection des smartphones. Le génie littéraire de Mme Munro est son habileté à capturer des récits complexes sur les subtilités des relations humaines et les nuances de la vie quotidienne dans le médium de la nouvelle. Ces femmes distinguées sont des leaders dans leurs domaines et leurs réalisations ont contribué à façonner notre monde et à inspirer d'autres femmes en sciences et femmes innovantes !

Can AI own the IP in its creations? Yes, but the question is far from settled.   In July 2021, DABUS became the world’s first AI patentee when the South African IP office granted DABUS’ patent for “a food container based on fractal geometry”.  DABUS – short for "Device for the Autonomous Bootstrapping of Unified Sentience" is an AI system designed to generate new ideas – “to invent” - without human intervention. DABUS’ inventions include its patented food container as well as a flashing light for attracting attention in emergencies. Its creator Dr. Stephen Thaler filed several patent applications naming DABUS as inventor in various countries including Canada, sparking debates about the ethical implications of AI systems being granted patent rights.  Other than South Africa and Canada, where its application is still pending before CIPO, DABUS’ patent applications have been rejected by the other patent offices.  However, with the skyrocketing popularity of AI that are capable of generating written content and artwork such as ChatGPT and DALL-E (which created the artwork for this post!) the question of IP ownership of AI creations is one of the hottest issues in IP law today.

The Matterhorn, a renowned emblem of Switzerland, is disappearing from the packaging of the iconic Toblerone chocolate bar.  Why?  Because some production is being moved to Slovakia later this year and the confection will no longer be “Swiss enough” to be called “Swiss milk chocolate” or display recognized Swiss emblems such as the Matterhorn.  Since 2017, Switzerland’s “Swissness” law has protected the prestige and reputation of products claiming an association with Switzerland by requiring certain origin criteria – i.e. domestic production.  Going forward, Toblerone packages will lose the Matterhorn image for a stylized and generic mountain, and read only “Established in Switzerland in 1908”.
 
Le Cervin, symbole emblématique de la Suisse, disparaît des emballages de l'iconique tablette de chocolat Toblerone. Pourquoi? Parce qu'une partie de la production sera transférée en Slovaquie plus t**d cette année et que la confiserie ne sera plus «assez suisse» pour s'appeler «chocolat au lait suisse» ou afficher des emblèmes suisses reconnus tels que le Cervin. Depuis 2017, la législation "Swissness" a protégé le prestige et la réputation des produits revendiquant une association avec la Suisse en exigeant certains critères d'origine - c'est-à-dire la production domestique. À l'avenir, les emballages de Toblerone perdront l'image du Cervin qui sera remplacé par une montagne stylisée et générique, et ne liront que "Fondé en Suisse en 1908".

Did you know?  Canada recently extended the copyright term for literary, dramatic, musical, and artistic works from 50 to 70 years after the death of the author, bringing our own law in line with international standards and the laws of most of our largest trading partners.  These changes to the Copyright Act came into force on December 30, 2022 and mean that copyrighted works will remain protected for a longer period, giving Canadian creators – authors, musicians, artists – more time to derive economic benefit from their works. 
 
Saviez-vous que le Canada a récemment prolongé la durée du droit d'auteur pour les œuvres littéraires, dramatiques, musicales et artistiques de 50 à 70 ans après le décès de l'auteur, alignant ainsi notre propre loi sur les normes internationales et sur les lois de la plupart de nos principaux partenaires commerciaux ?  Ces changements à la Loi sur le droit d'auteur sont entrés en vigueur le 30 décembre 2022 et signifient que les œuvres protégées par le droit d'auteur resteront protégées plus longtemps, ce qui donnera aux créateurs canadiens - auteurs, musiciens, artistes - plus de temps pour tirer un avantage économique de leurs œuvres.

Did you know it is possible to register sounds, scents, tastes, holograms, textures and motion as trademarks as Canada?  Changes to the law in 2019 opened the door for a wide range of “non-traditional” trademarks. There are now over three hundred applications for these new kinds of marks being reviewed by the Canadian Intellectual Property Office.  So the next time you encounter “A unique scent of a pungent, aldehydic fragrance combined with the faint scent of a hydrocarbon wax and an earthy clay”, what you may actually be smelling is a trademark for….crayons!   We registered the iconic sound of the MGM Roaring Lion in 2012 well before the amendment to the law … No doubt we can help with other non-traditional trademarks too!
