On October 1st, 2020, the provincial government brought forward new rules that allow for real estate agents and brokers in Ontario to form Personal Real Estate Corporations (“PRECs”). PRECs now allow agents and brokers to access many of the business advantages of incorporation, including income and tax planning benefits.

While this opens up exciting new opportunities for agents and brokers across Ontario, these changes also present a number of important legal implications. We encourage you to seek advice from an experienced business lawyer before taking action.

COVID-19 and Estate Planning: Let’s Talk. For Free.

In an effort to do our part and help our community during this difficult time, we have decided to offer a free 30-minute consultation on Wills and estate planning to all new and existing clients for the duration of the pandemic. We will also offer a discount of $150 on all Wills and Power of Attorney services until July 1, with the option to defer any payment up to 60 days. We hope these measures will provide much-needed flexibility for clients looking to better protect their families during COVID-19.

To ensure the health and safety of our clients, and in accordance with the Ontario government’s recent direction, all communication and signing of estate planning documents will be conducted remotely through the use of online video platforms such as Skype, Google Meet or Zoom.

Independent Contractor or Employee?

Most businesses today use a mix of employees and independent contractors to satisfy their staffing and operational needs... But do you know the practical differences between these two categories?

This often overlooked distinction in employment relationships can result in significant liability for a business, including claims for termination and severance pay, vacation pay, statutory holiday pay, etc, as well as being required to pay unremitted taxes, CPP, EI, and workers' insurance premiums in some cases.
