We bring expertise built from long relationships with First Nations, Inuit associations, Métis and associations, Tribal Councils, and the important economic development corporations and other businesses that do this important work throughout the vario

us regions of Canada. We are both litigators and negotiators, and we have appeared at all levels of Court including the Federal Court of Appeal and the Supreme Court of Canada most recently. We currently have lawyers called to the bars of Ontario, Nunavut, and Manitoba, with permission to appear in Quebec. Westaway Law Group also has a strong Supreme Court agency practice that services litigators across Canada who will appear before the Supreme Court of Canada in any matter. Our litigation expertise also includes specific experience before the Federal Court of Canada including the Federal Court of Appeal. Finally, Westaway Law Group litigation experience has a special focus on the North. We have worked frequently in the Yukon, the Northwest Territories and in Nunavut. We are presently called to the bar in Nunavut and are ready to appear in matters in that region. Westaway Law Group continues to provide both strategic legal advice as well as operating as the lead negotiator on several key Impact Benefit Agreement negotiations. We are also regularly involved in Specific Claim negotiations, global settlements, participation agreements with mining companies and other resource companies, forestry management planning negotiations, as well as wind farm and solar energy project talks. On July 16th, the Supreme Court of Canada ruled in favour of Lac Seul First Nation in a long-standing dispute with the federal government over compensation for flooding of their Reserve lands for a hydroelectric project. This decision brings greater clarity to the law around equitable compensation and is a win for all groups advancing historical claims. On March 25, 2021, the Supreme Court of Canada released its decision in Reference re Greenhouse Gas Pollution Pricing Act. The central issue in this case is whether the matters addressed in the Greenhouse Gas Pollution Pricing Act (the GGPPA) are matters of sufficient national concern that they fall within federal jurisdiction.

The Court found that establishing minimum national standards of GHG price stringency to reduce GHG emissions is a matter of national concern and one that the provinces, whether acting separately or together, are incapable of addressing.
