"The Civil Remedies Act essentially permits the government the extraordinary remedy of asking a court to extinguish the private-property rights of an individual where that property is deemed to be the proceeds or instrument of unlawful activity — whether or not they’ve been charged with an offence, never mind convicted,” explained Ottawa appellate lawyer Erica Tanny, who served as co-counsel with Ottawa criminal defence lawyer Alan Brass for Norwood’s estate and business in both the Superior and Appeal Courts. Veteran appellate lawyer Geoffrey Adair, founding partner of Adair Goldblatt Bieber LLP in Toronto, argued the appeal.

Brass said the Court of Appeal ruling provides direction that the Civil Remedies Act “must be applied and interpreted in accordance with its intended purpose, while protecting the rights of citizens,” and not “the expansive interpretation the Attorney General was seeking that would allow it to do anything.”

"Conditions at the Ottawa-Carleton Detention Centre were “simply deplorable and unduly harsh,” an Ottawa judge said as he tossed the remaining 30 days of a man’s assault sentence, which had already been reduced, in part, for “unacceptable conditions of imprisonment.”

Ontario Court Justice Trevor Brown granted “enhanced credit” (...) after considering arguments made by his defence lawyer, Shira Brass, during his sentencing in late September, including testimony (...) and a lengthy affidavit with details of his incarceration that went largely unchallenged, Brown said."

Unproven allegations and non-criminal records should not show up on police record checks. This sensitive information should no longer be a barrier to employment, travel, volunteering, etc. The Ontario Government needs to proclaim this legislation before June's provincial election

Two years after Ontario unanimously passed legislation banning police departments from sharing information on innocent residents, the law is still not in force.
