The legal and financial consequences of not paying child support are incredibly severe. In Canadian family law courts, child support is considered the right of the child. 👶💰💲

Payments do not go to the other parent of the child but towards the child’s needs and wellbeing. If a parent is found to not pay child support, courts will take action to compel them to pay up.

This includes anything from:
- garnishing their wages (withholding wages to satisfy child support obligations)
- seizing their assets
- suspending their driver’s license or passport

If a parent continues to withhold child support, they may even receive hefty fines or imprisonment, especially if they are in contempt of court for not following a court order to pay child support.

Always pay child support as required and promptly report any financial changes to ensure payments reflect your current situation.

Paying child support where it is due is not just a legal obligation, but also a method to ensure your child’s basic necessities are met, alongside their wellbeing and future.

Child support does not go towards the other parent of your child, but to the child itself. It helps cover everything like housing, food, clothing, medical and educational expenses. Everything you would be taking care of if the child lived with you full time. It is your way of ensuring your child is taken care of in your absence.

Unpaid or delayed child support can negatively impact your child in the form of less opportunities and stress, not to mention a negative impact on your relationship with your child as well.

Legally, it can mean fines, penalties and other legal consequences as well.
Always ensure that any child support payments you make are timely and proportionate to your financial circumstances and income.

Legal fees are expensive, and the threshold for Legal Aid is so low!

It is very difficult for most Canadians to afford a lawyer to help them navigate their separation, divorce or other family law issues as they make too much to qualify for Legal Aid, but not enough to pay for a lawyer out of pocket. Luckily there is a solution! The Limited Scope Project!

The Limited Scope Project allows you to partially retain a lawyer to help you review your paperwork, meet important deadlines and get answers to major questions to make sure you are on the right track. It is different from retaining a lawyer completely as the lawyer will only help you with a part of the work regarding your family law issue, but you can choose which part that is and how much you want the lawyer to do, in line with your budget and finances! You can ease some of the burden on your shoulders!

Did you know about the Rule of 65?

In Ontario, there is no guarantee of entitlement to spousal support upon divorce. Entitlement is usually determined (using the Spousal Support Advisory Guidelines) based on how economically or financially dependent one spouse is on the other. The rule of 65 goes one step further to help figure out if a spouse is entitled to indefinite spousal support.

Simply put: if the duration of the marriage + the age of the spouse receiving support = >65 years, the spouse is entitled to indefinite spousal support.
Remember, this does not mean forever, but that there is no set end date for spousal support.

Thinking about separating?

Did you know that in Ontario, there is no minimum age where the court will begin considering the child’s wishes, views and preferences?

The best interests of the child is the most important factor that courts take into consideration when deciding matters related to parenting-time, decision-making authority and child support for the child. According to the Children’s Law Reform Act, one such aspect of deciding the best interests of the child is receiving input from the child about their relationship with each parent.

While this is by no means the sole determining factor of the child’s best interests, there is no age limit after which the court starts listening to the child’s preferences, though the views of older children are usually given more weight.

💡Did you know about the 40% rule?💡

In Ontario, if each separated parent cares for a child for 40% or more of the time, it could qualify as “shared parenting”. This will impact child support calculations under the Federal Child Support Guidelines.

While courts will also consider the nature of the time the child spends with each parent in relation to decision-making and caregiving when deciding child-support amounts, the 40% rule is primarily concerned with the physical time spent with each parent. Though it is a key factor, it does not automatically guarantee a certain outcome in child support calculations.
