There are still a small number of cases being fought against ICBC under the insurance system that existed before David Eby and the BC NDP took your right to fight ICBC away from you.

In this one, ICBC denied our hardworking client's claim because they said he would not have returned to work following a devastating workplace accident. They ignored the evidence showing the exact opposite and forced him to trial.

The Court awarded him the earnings ($1.9 million) that he has now lost because a hit and run driver left him for dead in a ditch in Mission.

Without the right to fight ICBC, and go before an impartial judge, this client would have spent the rest of his life in poverty despite buying car insurance that he thought protected him in this exact situation.

We're happy to have helped this young woman achieve some justice in a province where the right to fight insurance companies has been almost completely eroded by David Eby and the NDP. ICBC claims her serious injuries were "minor". The Civil Resolution Tribunal disagreed and handed the matter off to Supreme Court of British Columbia on the main claim relating to Thoracic Outlet Syndrome:

What happens when you're on a jury in a case involving an ICBC defendant?

Maybe you'll have your private information illegally accessed by an ICBC adjuster so that it can be given to the defense lawyer.
This and other poor conduct on the part of David Eby's monopoly auto insurer was recently described in the Court of Appeal decision Insurance Corporation of British Columbia v. Ari, 2023 BCCA 331 (CanLII), https://canlii.ca/t/jzn2n

And in another jury case, ICBC's lawyers are sued by their former defendant client after a jury dropped a $4 million judgment on them. Unfortunately he only had $2 million in third party insurance, making him liable for the $2 million overage. After petitioning into bankruptcy, he now has to sue his ICBC lawyers and ICBC. David Eby's Enhanced ICBC Dumpster Fire

David Eby's "enhanced" ICBC hit the front page of the Vancouver Sun after its most recent disaster in BC Supreme Court. Here's what the court said about the insurer that just charged this road star over $2700 for car insurance:

"Based on the consistent conduct of ICBC toward Ms. Taylor since her accident, I am unable to presume that ICBC will conduct itself honourably moving forward."

"It waits until a lawyer or the court is involved before it fulfills its obligations."

While they are paying you less after you've been hurt, they're paying their lawyers more to fight you if you try to access your benefits.

ICBC's army of private defence lawyers remain amongst the the highest paid public servants in the province.

According to one senior ICBC defence lawyer, ICBC just ramped up hourly fees paid to its lawyers to $400. Last year the 3 partners at his firm took in an average of $2.7 million dollars or nearly $1 million per lawyer at the firm ($8.2 million paid by ICBC to the firm).

ICBC's Enhanced Secrecy Program

6 years to trial to overturn ICBC's faulty claim that our client was 100% liable for a catastrophic car crash.

A main reason for the delay: for 5 of those 6 years, ICBC kept secret the fact that they removed important computer data from his truck while this hard working father was recovering from spinal surgery.
