Uncontested divorces in British Columbia.

Generally speaking, uncontested divorces can be done with the filing of a family action and an order filed with the court. The process is fairly straight forward and generally takes between 3-5 months. Sometimes, there are complications that prolong the process.

If you are getting divorced in order to remarry, make sure you allow enough time for the process.

Note that the Divorce Act states that the divorce does not take effect until the 31st day after the day the order is made. In rare cases, it is possible to get a waiver on the 31 days period in order to permit remarriage sooner but this requires a court application and appropriate facts. Again, best to allow enough time.

Get a will. And get it done right.

Jim Morrison got a will. But he didn't get it right.

Morrison drafted a simple will. It gave his estate to his then partner, Pamela Courson. However, if she passed away within 3 months of Morrison passing away, then, his estate went to his siblings.

Not good drafting as it turned out.

Courson passed away 3 years after Morrison. So Morrison's estate did not go to his siblings. But Courson herself died without a will, a situation called an intestacy. That meant that Morrison's vast estate went to her parents.

Reportedly, Morrison and the Courson parents did not get along. Presumably, Morrison would not have wanted them getting his estate, particularly instead of his siblings. But he had a badly drafted will so that is what happened.
