If you're residing in a different country but obligated to pay child support in British Columbia, be aware of section 19(1)(c) of the Federal Child Support Guidelines. This section allows the court to impute income if you live in a country with significantly lower effective tax rates than Canada.

The rationale is to ensure fair support for the children involved. The Court of Appeal case of Pousette v. Janssen, 2023 BCCA 176 sheds light on this provision and offers a comprehensive perspective on the application of section 19(1)(c) of the Guidelines.

In the midst of Vancouver's dwindling affordable housing options, the definition of "relocation" has become a common query for family lawyers. There exists no one-size-fits-all answer, as the law encompasses a range of factors that must be weighed when determining both what constitutes a relocation and whether it should be permitted.

In the case of Nelson v. Harris, 2022 BSCC 1916, despite a father's parenting time of three weekends out of four (equating to eight overnights per month), the Court ruled that a mother's move from New Westminster to Half-moon Bay was not a relocation, as it wouldn't significantly diminish the father's time with the child. This underscores the highly individualized nature of such assessments.
