I officiated an emergency wedding a few days ago at the Palliative care unit of the Jewish General Hospital.

This is my 5th end of life wedding celebration at a hospital (once the wedding even took place at the emergency room).

What was different this time is that it was a parent of one of the spouses that was dying and it was their wish to see the couple marry and be present at the wedding. The room was decorated from flowers to fairy lights and everyone was happy and smiling.

I’m very glad that I could be there for the family.

Yesterday I had to urgently see a client to sign a deed.
This beautiful woman is 101 years young (yes, no typo there- 101).
Still clear, funny and charming. Has some mobility issues hence my visiting her.
She even told me that if I’d return today, her picture would be even better since she’s seeing the hairdresser for haircut, style and color.
I told her that she’s beautiful just the way she is. Inside and out.

I was very uplifted by the visit.

Question from a client: my elderly sister is in a private residence with care and is depleting her money very fast. She already has debts.
I was advised she has about 6 more months. She did not do a will. What happens after she passes away? Will I be responsible for the debts? I am her only living relative and I live outside of Canada.

Answer:
When a person passes away there is a mandatory process of a will search with 2 registries in Quebec.
If no will turn out, then you, as her only surviving relative, will have to sign a notarial declaration with a notary, stating that you are the sole heir and you will be accorded the rights to be the heir.
However, you will need a liquidator/executor to manage the estate and file taxes, pay debts etc.
Because you live outside of Canada and you are not a Canadian tax resident, the revenue authorities will tax the estate heavily if you were to assume this role.
You could choose to name someone else to be the liquidator/executor (for example, as a notary, I offer these services). However, because as I read below that it seems that funds are limited, the fees you will have to pay a professional may outweigh the benefit.

If by the time she passes, the estate should be in debt and deficit, you must expressly renounce your acceptance within 6 months of the date of death in a notarial deed. The notary will register the renunciation, and you will have to send it to the revenue authorities.
That way, you will not be responsible for any debts of the estate.

As the year is coming to an end, I’d like to pay homage to a client.

I believe in the Jewish value of Tikun Olam - repair the world - a core Jewish idea about humanity's role in improving the world through acts of justice, compassion, and ethical living.
The client did exactly that.

I was the court appointed liquidator of her estate.
I never met or knew her but I learnt about her from people in her life.
She was Christian and was born in Germany. In the 1930s she married a German man who was a 1/4 Jewish. When the N***s hounded him, he wanted to leave her, but she refused and went on the run with him.
They ended up in Montreal Canada but en route she was brutally r***d and that was why she wasn’t able to ever conceive and have children of her own.
He died first and when she died she decided to leave her assets to a few hospitals foundations, women’s shelter- places that she knew could use the money and do good with it.

My hope and wish for this coming year and the years to come is that good, hope, love and kindness will be stepping stones to all of us.

Last week was busy with helping clients sign urgent, and not so urgent, deeds.
I saw the clients in their private homes, my office and a palliative house, including on Saturday, when I went to see a client at her home, with Dan as my witness.

Most of my adult life, in different jobs and professions I had, I have been helping women survivors of domestic abuse.

To the woman at the Ikea parking lot on Sunday. I Hope you are ok.

My car was at the far right, when all of a sudden I saw at the far left side a car stops in the middle of backing out of the parking spot, a woman came out and run backwards as the man who was driving came after her and started physically hitting her and yelling in a foreign language (from far it sounded like it could be Russian or Ukrainian?)

I left my full cart and yelled “hey stop - I’m calling the police” as I was reaching for my phone and running towards her at the same time. I’m not sure if they heard me or not but they got into the car quickly and drove off.

I didn’t see them from near enough to identify them or the car.

I couldn’t stop thinking of you. What happened when you got home and maybe no one was there to try and help?

I hope you are ok.

From far, in the snowing weather, she looked mature (maybe in her 50s, 60s?).

Do you have children? What would they think seeing such violence? It could happen everyday and take a toll on all of you.

Help is out there.

There are different services and shelters who offer advice and social workers.

To name a few:

Auberge Shalom.

Stats: One in three women worldwide experience physical or sexual violence, mostly by an intimate partner. Violence against women and girls is criminal and a human rights violation, and the immediate and long-term physical, sexual, and mental consequences for women and girls can be devastating, including death.

I know it’s not easy. I know all the types of abuse. I know it’s scary and seems so big and overwhelming.

Please don’t wait.
Seek help. You deserve better.
