Charness, Charness & Charness LLP is looking for an articling student to join our Common Law departement. This is a great opportunity to develop your skills in civil and commercial litigation, as well as other areas.

We offer genuine autonomy in court, while also providing direct guidance from experienced lawyers working on a wide variety of clientele. The internship is a chance to work with a young, dynamic, and welcoming team in an in person work environment. The office is located in the heart of downtown with a breathtaking view of Place d’Armes!

Joyeux centième anniversaire CC&C ! Le 26 octobre chez Le Mount Stephen, nous avons célébré 100 ans d'héritage, de résilience et d'intégrité. En 1925, un jeune avocat nommé I.J. Charness a ouvert un petit cabinet à Montréal, animé par un principe directeur : le droit doit servir les gens avec intégrité et équité. Cent ans plus t**d, Charness, Charness & Charness demeure l’un des plus anciens cabinets familiaux indépendants au Canada, toujours guidé par les mêmes valeurs et fièrement enraciné dans la communauté montréalaise.

Happy 100th birthday CC&C! On October 26th, we celebrate at Le Mount Stephen Hotel 100 years of legacy, resilience and integrity. In 1925, a young lawyer named I.J. Charness opened a small law office in Montreal with one guiding principle: that law should serve people with integrity and fairness. One hundred years later, Charness, Charness &Charness stands as one of Canada’s oldest continuously family-run law firms, still independent, still guided by those same values, and still proudly rooted in the Montreal community.

Congratulations to our very own Samantha Coladonato for becoming a lawyer. Samantha joined the Charness, Charness & Charness LLP family in 2019 as a paralegal. After completing her LL.B at the Université Laval in 2023 and successfully passing the bar exams, she began her stage at CC&C in August 2024. She has now joined our firm as a lawyer overseeing some of the portfolios she helped to build. We are so proud of her growth and are excited to see her continue to develop into the amazing lawyer that we know she is. Welcome Me. Coladonato !

Charness Charness and Charness LLP congratulates our very own Maitre Ousmane Ndiaye-Kaberamanzi on his recent win at the Court of Appeal!

As one of the firm's specialties is assisting foreign clients to have their judgements recognized in the province of Québec, it was good to see the Court reaffirming a key principle in the recognition of foreign judgments. The Court of Appeal agreed with our position confirming that the validity of service must be assessed according to the law of the jurisdiction where the judgment was rendered (Niu v. American Cinema Inspires, 2025 QCCA 100).

In this case, our American clients sued the appellant and other individuals for copyright infringement due to their illegal distribution of their cinematographic content and obtained a default judgment in the United States. The appellant maintained that his being served by email was not legal service and therefore the Arizona judgement should not be recognized in Québec.

The Court of Appeal ruled that since service by email complies with international standards and was authorized in Arizona, it was deemed valid in Québec, despite the appellant’s challenge and claims regarding his identity.

The foreign judgement was therefore duly recognized as a valid judgement against the appellant that can be enforced in the province of Québec.

Charness, Charness & Charness LLP félicite Maître Ousmane Ndiaye-Kaberamanzi pour sa récente victoire devant la Cour d’appel!

L’un des domaines d’expertise de notre cabinet étant d’aider nos clients étrangers à faire reconnaître leurs jugements au Québec, il est encourageant de voir la Cour réaffirmer un principe clé en la matière. La Cour d’appel a confirmé notre position en statuant que la validité de la signification d’un jugement étranger doit être évaluée selon la loi de la juridiction où il a été rendu (Niu c. American Cinema Inspires, 2025 QCCA 100).

Dans cette affaire, nos clients américains avaient poursuivi l’appelant et d’autres individus pour violation de droit d’auteur en raison de la diffusion illégale de leur contenu cinématographique et avaient obtenu un jugement par défaut aux États-Unis. L’appelant soutenait que la signification par courriel n’était pas légale et que le jugement rendu en Arizona ne devait donc pas être reconnu au Québec.

La Cour d’appel a statué que, puisque la signification par courriel est conforme aux normes internationales et avait été autorisée en Arizona, elle devait être considérée comme valide au Québec, malgré la contestation de l’appelant et ses prétentions quant à son identité.

Le jugement étranger a donc été dûment reconnu comme un jugement valide pouvant être exécuté dans la province de Québec.
