Question: I have been told by friends that even if I don't own our home legally, the house actually belongs to both my spouse and me because it's a matrimonial home. Is this true?

Answer: No, this is definitely not true. The reason people believe this is because the entire value of the matrimonial home is shared between the parties upon separation, even if one spouse owned the home prior to the date of separation. With all other assets, if a spouse owned property on the date of marriage, that spouse receives a "deduction" from his or her Net Family Property for the value of the same. If a spouse owed the home you live in at the date of separation at the date of marriage, however, there is no deduction for the value.

So, if you had bank accounts on the date of marriage worth $200 and bank accounts worth $1000 on the date of separation, you get a $200 deduction, and $800 goes into your net family property. If your matrimonial home was worth $500,000 at the date of marriage and $1.5 million on the date of separation, the entire value is included in your net family property.

This is obviously simplistic and there are other factors, but this is the essence of why people mistakenly believe they jointly "own" the matrimonial home at the date of separation, even if one spouse's name is not on the deed.

The moral of this story is "do not get your legal advice from friends!"
