Spousal Sponsorship Refusal – Can You Appeal Inland or Outland Cases?

Appeal rights depend on whether the sponsorship application was filed in Canada or outside Canada.

Outland Sponsorship:

Usually has appeal rights through the Immigration Appeal Division (IAD).

You may challenge the refusal and present additional evidence.

Inland Sponsorship:

Typically does not have full appeal rights.

The main option may be Judicial Review in the Federal Court.

Marriage genuineness, proof of cohabitation, communication history, and financial support are critical in these cases.

Strong documentation can significantly improve the chances of approval.

To keep your PR status, you generally must meet the residency obligation:
✔ Be physically present in Canada for at least 730 days within the last 5 years (subject to certain exceptions).

Failure to meet residency requirements could put your PR status at risk.

⚠️ An expired PR card does NOT equal expired PR status.

📌 Know the difference and plan ahead before you travel.
