Systemic racism and discrimination are a reality for too many in Canada’s criminal justice system—a system that is meant to protect people, not to harm them. Black History Month gives us an opportunity to reflect on the work that still needs to be done to improve our justice system.

Black persons are overrepresented in the criminal justice system, as offenders and victims. In Fall 2022, changes were made to Canada’s criminal law, including to sentencing practices, to help address overrepresentation.

These changes:
• repealed certain mandatory minimum penalties that have contributed to overincarceration
• increased the availability of conditional sentence orders where appropriate
• now encourage the greater use of diversion programs for simple possession of drugs
