Landmark Supreme Court of Canada Decision

Earlier this year, the Supreme Court of Canada released a significant decision formally recognizing a new civil tort of intimate partner violence.

The Court also acknowledged that intimate partner violence is not limited to physical assault. It can include patterns of coercive control, intimidation, isolation, humiliation, surveillance, financial control and sexual coercion.

Just as importantly, the Court recognized that these patterns of behaviour can cause cumulative harm that traditional claims such as assault, battery or intentional infliction of emotional distress may not fully capture.

This is a very significant development for survivors of intimate partner violence and reflects the law’s growing recognition that abuse can take many forms — including conduct designed to undermine a person’s autonomy, dignity and independence.
