A missed restoration deadline left a child out of status. And under Canadian immigration law, that didn’t just affect the child.
Under Section 41(a) of the Immigration and Refugee Protection Act (IRPA), a foreign national is inadmissible for failing to comply with the Act through any act or omission that contravenes, directly or indirectly, a provision of the IRPA.
A family member out of status is a non-compliant family member, and that non-compliance put the entire family’s permanent residency goals at risk.
