Your long-term disability claim was denied. Now what?

Your insurance company's denial letter will probably tell you that you have the right to appeal.

But here's something many people don't realize:

👉 You don't necessarily have to appeal before considering a lawsuit.

An appeal can absolutely make sense in the right case — especially if important new medical evidence is available.

But if the insurer already has strong evidence supporting your disability and has denied the claim anyway, simply sending the same information back and asking them to reconsider may not be the best strategy.

There is also a very important timing issue:

⏰ Don't assume that appealing your LTD denial stops the deadline for starting a lawsuit.

Were you terminated before you applied for long-term disability benefits?

You may still have a claim.

Many people struggling with chronic pain, anxiety, depression, PTSD, concussion symptoms or other disabling conditions continue working for as long as they possibly can.

Sometimes their performance begins to suffer. They miss work. They struggle to keep up. And before they ever formally apply for LTD benefits, they're terminated.

It's easy to assume that losing your job means losing your right to disability benefits.

But that isn't always the case.

One of the key questions may be whether you became disabled while your LTD coverage was still in place — even if you continued trying to work or didn't submit your application until later.

Medical records from before the termination can be especially important in these cases.

“I don’t think they believe me.”

It’s something we hear far too often from people living with invisible disabilities.

Chronic pain. Fibromyalgia. Chronic fatigue. Migraines. Autoimmune conditions. Depression. Anxiety. PTSD.

These conditions may not always be visible — but their impact on a person’s ability to work can be very real.

Unfortunately, insurance companies may focus on things like a lack of “objective evidence,” an isolated good day, or the fact that someone appeared comfortable during a brief assessment.

But that can miss the real question:

Can this person function consistently and reliably in a work setting?

Being able to do something once — or having a good day — is not the same as being able to sustain the demands of a job day after day.
