Yet another case where I overturned a spousal sponsorship refusal and a misrepresentation finding at the Immigration Appeal Division.

My client’s spouse from Zimbabwe had a police clearance certificate from South Africa with a date discrepancy that the officer deemed fraudulent. I argued the discrepancy was not clear evidence of fraud, and after a six-hour hearing, the IAD agreed, setting aside the misrep finding and ordering continued processing. After two years, the family is finally reuniting in Canada.

I just successfully overturned an IRCC officer’s decision that found my client inadmissible for misrepresentation. The refusal lacked a procedural fairness letter, so we challenged it with a reconsideration request and judicial review. We discovered discrepancies in the PFL dates and lack of evidence that the PFL was actually sent or delivered to my client. The case law we relied upon showed that on numerous occasions the Federal Court ruled that IRCC bears the risk of email transmission failures. As a result, after we advanced our arguments we received a settlement offer from the Department of Justice and had the application reopened for our client…

Mass refusals for grduates of are coming in. IRCC now retroactively applies the rules that were not existent until June 24, 2026, and refuses the applications because the applicants studies in a “non-credit” program.

These refusals are troubling because the law shall not be applied retroactively to penalize the applicants for the rules that were never communicated to them when they began their program of study. Even more, the new rules were not posted anywhere even after the applicants completed their program and submitted their PGWP application.

Here is a mistake I see all the time with self-represented applicants: they hope the officer will go through hundreds of pages of submissions to try and make sense of it all. This is false.

While an officer must consider all evidence submitted, that evidence must be clear and easy to understand. You must explain why you included a particular document, what that document is, how it supports your application, and how it connects to your other evidence. The onus is always on the applicant to convince the officer of their temporary intent, purpose of travel, and ability to afford the trip.

Simply dumping a bunch of documents into an application without context is a straight pathway to a refusal.

Federal Court in Canada issued an order extending the timeline for perfecting applications for leave in judicial review, effective June 26th, due to unprecedented pressure from increased immigration proceedings. Here I explain why notwithstanding the deadline being extended to 120 days, applicants are expected to file within the usual 30-day deadline where possible, or well before the extended deadline… ImmigrationLawyer
