Deciding Between a Notary and a Lawyer?

The difference between a notary and a lawyer becomes especially important when a transaction involves complex legal issues. Unlike lawyers, notaries cannot represent clients in disputes, negotiate contract terms, or provide legal advice regarding title concerns or defects.

If complications arise during or after a real estate transaction—such as a party refusing to complete the sale, unexpected title issues, or claims related to post-closing defects—a notary-managed file may require the buyer or seller to hire a lawyer separately.
