⚖️ A Question We Get Often: What Is a Conflict of Interest?
In a small community, it’s not uncommon for people to know one another, be connected through family or business, or have had dealings with the same law firm at different points in time. As a result, questions about conflicts of interest are something we receive regularly.
Generally speaking, a conflict can arise when our firm has previously represented another person or party whose interests are now opposed to yours. In those circumstances, professional obligations may prevent our firm from acting against that former client.
One important point: the conflict is with the firm, not simply with the individual lawyer who handled the previous matter. This means that changing lawyers within the same firm does not necessarily resolve a conflict.
