Mandates

Recent reports indicate that some pandemic restrictions may be lifted soon in Ontario, perhaps on a gradual and phased basis. While there are many considerations before the mandates are lifted, it is refreshing to hear that we are heading towards some normalcy. Precautions still need to be taken to keep everyone safe, however with tools to combat this pandemic, we are hopeful that this global challenge is at least now reduced.

Mortgages

Getting a mortgage pre-approval and ensuring that you have factored in all costs, including closing costs, is critical when it comes to purchasing a property. Purchaser’s should be ready with their financing on the closing date as extensions may not be granted by the seller. Note that you run the risk of losing your deposit and incur further liability, should you be unable to close on closing date and where an extension is not granted.

The earth continues its orbit around the sun, which means that spring will be upon us shortly. In the real estate world, the spring market is often regarded as one of the busiest times for buying and selling a home. While housing supply has been hovering at low levels recently, purchasers especially are reminded to ensure that they discuss offers and any required conditions carefully with their realtors to ensure that their interests are protected. Where possible, have the offer reviewed by your real estate lawyer to ensure that you understand the obligations fully whether you are buying or selling property.

New Year, New Homes, New Forms and... the New Variant

A new year symbolising new beginnings is certainly not a new concept, and with the ringing in of 2022, many may be considering purchasing a first home; or entering the real estate investment market. If the purchase of a new home or property is on the cards this year, Overmeyer Law is available to assist you with your real estate closings.

Estates – New Forms

It is of utmost importance to ensure that you have a Will as well as Powers of Attorney to protect your family and dependants should you no longer be there. Contact our offices to have your Wills and Powers of attorney prepared or updated as a lasting legacy to your loved ones. New Court forms for estate administration have come into effect on January 1, 2022 that will hopefully assist in ensuring a simpler and more time efficient estate administration process.

The Omicron variant

With the omicron variant, Overmeyer Law is committed to delivering essential legal services in a manner that protects the health and safety of our clients, staff and community. We are working remotely whenever possible and utilizing technology to reduce the need for in person meetings. Our office remains open but we strongly encourage the use of telephone and video conferencing. Our facilities are regularly sanitized and a strict social distancing policy is being carefully followed.

2022

Collectively, we have had a lot to deal with in recent times as human beings in a global pandemic. However, as the saying goes: “Rough seas make strong sailors”. WHEN THE PROPERTY YOU PURCHASED IS HAUNTED. WHAT THE LAW SAYS…

The presence of a ghost in a home is not something that most home inspectors would be able to detect during a routine inspection. Ghosts are usually invisible and therefore may not be discovered or “show themselves” until after a new owner has settled in. What happens when a seller fails to disclose to a buyer that they would have to share their home with spirits?

In Ontario, this question was considered in 178477 Ontario Inc. v K-W Labour Association et. Al. 2013 ONSC 5401. In this case, the plaintiff purchased a commercial property from the defendant in September 2010. Two months later, a local newspaper article quoted the director of the defendant vendor as stating that a number of people had seen “somebody moving around in there and there is nobody there.” This alleged haunting was not disclosed before the property was sold. The plaintiff’s commenced legal action on the basis that this was a latent defect that was not disclosed to them.

The court ruled that there was no obligation on the vendor to disclose the alleged haunting, and the vendor was not liable for damages for a latent defect.

Under Ontario Law, the seller has no obligation to disclose ghostly apparitions, or even if the house was a site for a murder, su***de or accidental death. The principle of “buyer beware” applies, and the onus is on a buyer to conduct due diligence. If paranormal activity in a home is not something you would like to contend with, ensure you do your research on a property’s history before making an offer.

Over the course of more than 100 years, some 150 000 Indigenous children were ripped from their families and forced into residential schools where they suffered atrocious abuse, malnutrition and neglect. More than 4000 children are believed to have died.

September 30, 2021 marks the first National Day for Truth and Reconciliation. This Federal Statutory holiday is intended to honour the lost children, as well as residential school survivors, their families and communities. We stand in solidarity with the Truth and Reconciliation Commission, Indigenous Leaders and their communities, and encourage all to learn about and reflect on this dark and tragic chapter in our history.

September 30 is a new statutory holiday - National Day for Truth and Reconciliation. It applies to all federally regulated public and private workplaces - including banks. This will affect real estate purchase and sale closings. Avoid this as a closing date!
