After a motor vehicle accident in Ontario, there may be more than one type of claim available.

Accident Benefits (SABS) may provide certain benefits regardless of who caused the accident. Following the July 1, 2026 changes, medical, rehabilitation and attendant care benefits remain mandatory, while several other Accident Benefits are optional.

A plaintiff-side personal injury claim, sometimes called a tort claim, is different. It involves pursuing a claim against another party alleged to be legally responsible for the accident and resulting injuries and losses.

Depending on the circumstances, an injured person may have an Accident Benefits claim, a plaintiff-side claim, or both.
