Been told it’s “just whiplash” or “only a soft tissue injury”?

Soft tissue injuries can be difficult to see on standard medical imaging, but their effects can be significant. Ongoing pain, headaches, reduced mobility and difficulty working or completing everyday tasks may continue long after an accident.

A soft tissue diagnosis describes the type of tissue affected. It does not determine how serious the injury is or how quickly someone should recover.

No-Fault Update

Recent media coverage featuring KMSC Law Managing Partner Owen Lewis has brought renewed attention to the serious risks in Alberta’s planned Care-First auto insurance system.

New AIRB data show overall claim costs fell from $1,825 in 2024 to $1,398 in 2025, with severe weather, not ballooning injury costs, driving much of the previous year’s increase. Yet Albertans are still being asked to accept a system that would significantly restrict their ability to seek fair compensation through the courts.

As Owen put it: “They’re leaving compensation up to the private insurance companies to determine what an injured Albertan is going to receive.”

The promised premium savings are also becoming less clear. The latest estimate is roughly $297 per private passenger vehicle, down from earlier projections of about $400, while the potential losses for injured Albertans are substantial: fewer rights, less accountability, and less certainty following a serious collision.

KMSC Law believes Albertans deserve an evidence-based auto insurance system that protects injured people, preserves access to justice, and holds insurers accountable.

📘 Injury Law 101

Today’s term: Section B Benefits

Section B Benefits are mandatory accident benefits included in Alberta automobile insurance policies. They are often called “no-fault” benefits because they may be available after a motor vehicle collision regardless of who caused it.

Depending on the circumstances, Section B Benefits may provide:
• Coverage for eligible medical treatment, rehabilitation and medication
• Disability benefits replacing a portion of lost earnings
• Death, grief counselling and funeral benefits

These benefits are separate from a tort claim against an at-fault driver. An injured person may be eligible for Section B Benefits while also pursuing compensation through a personal injury claim.

Section B Benefits are not necessarily provided automatically. You must notify the appropriate insurer, submit the required forms and provide supporting medical information. Deadlines may also apply.
