The Dower Act⚖️ relates to marriage and is used when there is only one person buying or selling property. Its intent is to provide some protection to a spouse that is not on title to their home. The Dower Act has no middle ground. You are either married 👰🏽‍♀️🤵🏻‍♂️or not. For example, separated spouses are considered married until divorced.

If you are married and one of the spouses have lived in the property🏡 since the time of marriage, then the Act applies and the spouse not on title must either sign a Dower Release or a Dower Consent. A Dower Release releases all rights to the property. A Dower Consent is mostly used when selling a property and it confirms with the spouse who does not own the property that they are okay with their spouse selling the property.✔️

Patent and Latent are defects that are found on a property after a person has moved into a property.🏚🏚

A Patent Defect is a defect that you can find with a reasonable inspection.

A Latent Defect is a defect that cannot be found in a reasonable inspection. As well, the seller had to know about the defect and chose to not disclose the defect.

Joint Tenancy and Tenancy in Common are two different ways that people can hold Title on a Property. In Joint Tenancy the people on the title hold the entire title together. All Title holders would have to agree to sell or refinance together and also if one person from the Title passes away the Title will be adjusted so the property is still in the name of those who are on Title. The survivor takes the Property. If there a Tenancy in Common, then each Title holder has an individual share in the Property that they can sell or refinance on their own and the other people on Title will remain on title. We adjust all costs before the transaction closes. 🏠With every purchase of a home there are ongoing expenses that are required during the sale process. Anderson Haak & Engels will adjust the final dollar amount that is due on the possession date based on those expenses. The best place to look for adjustments that will be made is on your purchaser contract. 👀One example of an adjustment is property taxes, if the seller has already paid the year of taxes, they will receive a credit from the purchaser. Land Title Transfer Fees 💰are the fees the Government of Alberta charges to register a transfer or a mortgage. In Alberta, the fee is paid by the buyer and is based on the value of the house🏠. The higher the value, the higher the fee. The Provinnce increased the fees charged substantially at the beginning of 2020 so, for example, the fees this year for a $300,000 house is $175 and the fee for a $250,000 mortgage is $125.

What is the role of a lawyer in a real estate transaction? 🧐
Lawyers main job is to protect your legal rights throughout your process of selling or purchasing the property. The lawyers at Anderson Haak & Engels will review the legal documents to make sure you get what you bargained for.

Before signing any important documents we will be happy to look over the Contract if asked because once you sign it becomes legally binding and there are elements of the contract that may impact you in the future.

Once your offer has been accepted, your lawyer will make sure that that the person selling the property is the registered owner as well as make sure that there are no liens, unpaid taxes, go over the RPR or anything else that may negatively impact the real estate transaction. If there are any of these situations, we will provide the best way to ensure that there is clean transfers of titles.
