Today, One of our client received Procedural Fairness Letter (PFL) from IRCC spousal open work permit. “Don’t Panic, Understand It “ Many applicants believe a PFL means their application is about to be refused. Not necessarily.
A Procedural Fairness Letter is IRCC’s way of giving you an opportunity to address concerns before a final decision is made. We’ve seen cases where IRCC has questioned:
✔ Employment status of spouse in Canada
✔ Job offers/employer information or misrepresentation
✔ Pay stubs and salary deposits
✔ Supporting financial evidence
✔ Eligibility for a spouse’s open work permit
And here’s something many people don’t know:
⚠️ A Procedural Fairness Letter can sometimes be issued even after a work permit or visa has been approved if IRCC later identifies concerns regarding eligibility, employment, documentation, or possible misrepresentation. The key is not to ignore the letter. A well-prepared response supported by the right evidence can make a significant difference.
Every case is unique, and understanding exactly what IRCC is questioning is critical before responding.
