If your licence was suspended (possibly for unpaid fines, alcohol related infractions, too many demerit points, or other reasons) and you are caught driving, you will be charged with driving with a suspended licence.

This is one of the most serious infractions under the Alberta Traffic Act. If convicted, your licence will automatically be suspended for a further six month period, and your insurance premiums will skyrocket. You may end up paying thousands of dollars more for insurance – and that’s only if you qualify. Some companies will refuse to insure you if you have been convicted of driving while suspended. At the very least, your insurance could be affected for three years or more. Depending on the situation, you may also end up in jail.

WHAT ARE THE PENALTIES?
If this is the first time you have been charged with driving under suspension, you face the following consequences:

A fine of not more than $2,700 + 15% surcharge

Further suspension of your licence for 6 months from the end of your current suspension

Failure to pay fine will result in 14 days to a maximum of 6 months in prison

If this is your second offence within one year of the original offence, you face the same penalties as above, plus jail time from 14 days to 6 months.

If you drive for a living, you need to protect your livelihood. Truck drivers, school bus drivers, and other commercial vehicle drivers need to be aware of the rules and regulations surrounding their jobs. If you have been charged with a commercial driving infraction, it can lead to serious consequences that put your ability to provide at risk.

Ensuring you are operating a safe vehicle, having all the proper permits and tags, and following all safety regulations associated with your type of vehicle and load are extremely important to keep your Carrier Safety Rating and CVOR record as clean as possible. These are public records, which means your track record is available to everyone – most importantly your customers and competitors, but your insurance company and financial institutions, as well.

Commercial vehicle offences are serious, and we take them seriously. If you have been charged, let us be your first stop.

As a motorist, you are required to obey all signs and traffic regulation devices. Failing to stop, either at a red light, a stop sign, or a different traffic control device can result in loss of demerit points and a fine. The most common occurrence is failing to stop at a stop sign. Even if you believe the way is clear, you must come to a complete stop within 3 meters of the road way. Failure to do so, or rolling through a stop sign, will result in this charge if you are caught. Failing to stop at a red light has more negative consequences, as insurance companies view this more seriously and will increase your premiums accordingly. Failing to stop will stay on your driver’s abstract for 3 years. Seek our traffic court agents to help in Edmonton to fight your case. Speak to us to protect your licence.

We have a qualified team of experienced traffic court agents who can fight your case if you have been accused of driving under suspension or for dangerous driving.

WHAT ARE THE PENALTIES?
A fine of $405

3 demerit points

A conviction on your driving record for 3 years (POINTS WILL STAY FOR 2 YEARS)

Some of the other consequences of a stop sign violation include:

Employee Background Check

Some of the employers might check your driving record when you apply for a job. Your employers may want to know whether you pose any risk of liability to them if you get into an accident during office hours.

Insurance Rates

The car insurance companies may use traffic violations to evaluate how much risk you are to insure. The higher the risk of you getting into an accident, the higher the insurance premiums are likely to be.

FAILING TO REMAIN AT THE SCENE OF AN ACCIDENT

This is the most serious of all the charges under the Traffic Safety Act, and is commonly called a "hit and run". A driver who has been involved in an accident is required to remain there, or return quickly. If you have been involved in an accident with another person, you should call the police immediately. You are also required to offer assistance to anyone who is injured. If you hit an unattended vehicle, you need to stop and either locate or notify the owner of the vehicle and provide them with your details. By failing to remain at the scene of a collision, you are risking being charged under the Traffic Safety Act and, depending on the situation, the Criminal Code of Canada. If it can be proven you fled the scene to avoid criminal or civil liability, the penalties will be much more severe.

WHAT ARE THE PENALTIES?
Fines start at $405 and go up to $2,300

7 demerit points

Possibly up to 6 months in prison under the Traffic Safety Act

Up to 5 years in prison under the Criminal Code of Canada

The most common reason to be charged with stunt driving is Loud Unnecessary Noise, or other activities that distract other drivers. Other reasons include but are not limited to racing, trying to lift wheels off the ground ("wheelies"), spinning/circling without control ("doughnuts"), driving with a person in the trunk, driving while not sitting in the driver seat, or driving in the oncoming lane beside another vehicle.

This charge carries serious penalties as these activities are extremely dangerous while driving. If you are convicted of stunt driving, other than the consequences below, your insurance premiums will be affected for up to 3 years. Some insurance companies will refuse to insure motorists who have been convicted of stunt driving, so it is in your best interest to fight this charge.

WHAT ARE THE PENALTIES?

A fine from $567 and up to $2,700

3 demerit points

Mandatory court appearance (pink ticket)

Possible suspension of your licence for no more than 90 days

Possible jail time of up to 6 months

HAVE A SPEEDING TICKET IN EDMONTON? WE ARE HERE TO HELP!

Speeding is probably the most common charge related to traffic offences. Every road has a set speed limit, whether posted or not. It is your duty as a driver to obey all posted speed limits, as well as understand the regulations regarding types of roads and automatic limits. By driving over the speed limit, you are risking being charged with speeding, and you are putting yourself and others in danger. Speed limits are enforced for your own safety, and the safety of other motorists and pedestrians.

WHAT ARE THE PENALTIES?
The fines and demerit points associated with speeding are based on the alleged rate of travel above the speed limit. The demerit points are as follows:

1-15 km over – 2 points

16-30 km over – 3 points

31 – 50 km over – 4 points

50+ km over – 6 demerit points plus possible loss of licence for 3 months plus possible incarceration

The fines for speeding range from $81 - $495 depending on your rate of travel. Speeding through a set construction zone will result in an immediate doubling of the normal fine. Every conviction for speeding will stay on your record for a period of 3 years.

Usually this is a charge that will be used if a vehicle has been involved in a collision. This charge is widely open to interpretation, which makes it one of the most common charges laid in traffic incidents.
