What happens if you submitted an outland spousal sponsorship application and your spouse is now in Canada?

Your application does not automatically switch to an in-Canada application.

If you submitted a Family Class application, it can continue processing even if your spouse is now in Canada. If you want to submit an application under the Spouse or Common-Law
Partner in Canada class, you would generally need to withdraw the existing application and submit a new one.

The right option depends on your circumstances, so make sure you understand the implications before making a change.

Receiving government benefits does not automatically mean you cannot sponsor your spouse.

The important question is what type of benefit you are receiving. Social assistance for reasons other than disability can affect your eligibility, while benefits such as Employment Insurance and tax credits are treated differently.

And in most spouse and partner sponsorship cases, there is no minimum income requirement.

For example, you could qualify for the French-language category while also meeting the requirements of an occupation-based category.

Being eligible for multiple categories doesn’t mean receiving multiple invitations, but it can give you more opportunities to be selected.

A visitor visa isn’t always the best option for parents who want to visit their children in Canada.

In a recent case, our client’s parents had previously been refused a visitor visa due to concerns about their financial situation and the purpose of their temporary stay.

After reviewing their profile, we recommended considering a Super Visa. Since the parents were retired and had limited personal income, the application could take into account both their financial situation and the daughter’s ability to support them, provided the eligibility requirements were met.

The Super Visa can also allow eligible parents and grandparents to stay in Canada for extended periods, with requirements including medical insurance and a medical exam.
We’re happy to share that this application was approved.

Can you study in Canada without a study permit if you already have a work permit?

As of September 4, 2026, IRCC has indicated that some eligible work permit holders can study without an additional study permit if the program is six months or shorter.

If the program is six months or longer, a study permit is generally required.

Before enrolling in a program, make sure you understand how the rules apply to your specific situation.

Got an ITA through Express Entry?

Congratulations, but there’s still an important step ahead.

After receiving your Invitation to Apply, you have 60 days to submit your complete permanent residence application.

From gathering documents and submitting your application to responding to IRCC requests and waiting for the final decision, every stage matters.

And remember: receiving an ITA does not guarantee PR approval. Incomplete or inconsistent documentation can create serious issues during processing.

That’s why it’s important to approach the post-ITA stage with accuracy and a clear plan.

Every H&C application has a story, and when children are involved, that story needs to be especially clear.

We’re happy to share a recent child sponsorship application through H&C consideration that was approved within one year.

For these applications, some of the key factors we focus on include:

1. The circumstances behind any non-disclosure, including why a child may not have been declared in a previous application.

2. The parent-child relationship, including ongoing financial, emotional and regular communication.

3. The child’s best interests and hardship, including the impact of continued separation from their parent and family.

In this case, we also received a Procedural Fairness Letter (PFL), which allowed us to provide further context about the circumstances surrounding the child’s documentation.

A strong H&C application is about more than submitting documents. It’s about presenting a complete, consistent and compelling story to IRCC.
