Buying a power of sale property means accepting risk in exchange for a discount. Trying to load the contract with all the protections of a standard purchase misses the point entirely. The real skill is understanding what level of risk you are comfortable with and targeting deals that fit within that threshold.

Rook & Knight's job is to make sure clients have the full picture, encourage where it makes sense, and put a hard stop where it is genuinely needed. Guardrails that are too tight kill deals, and that serves no one.

There is no such thing as a risk free investment, and the goal of good legal counsel is never to eliminate risk but to help you understand it, box it in, and work it into your underwriting so you are prepared if it shows up.

It is easy for a lawyer to say do not do this deal. It is much harder, and much more valuable, to assess what the risks actually are, rank them by likelihood, and help a client make a fully informed decision. That is what a strategic legal partner does.

Multifamily transactions with investor capital and CMHC financing make up the core of what Rook & Knight does, close to 80% of the firm's work on any given day. Even through a difficult period for investors, deals are still getting done, and the ones moving forward right now tend to be the strongest ones.

The investors taking action in a tough market are buying at a discount, securing favorable terms, and finding that capital is still available for deals that are genuinely good. A slower market does not stop great deals, it filters for them.
