Immediate Roadside Sanctions ‘FAIL’ is issued under Section 88.1 of the Traffic Safety Act. If you receive an Immediate Roadside Sanction, you have a right to appeal your administrative decision. At Ticket Help we specialize in ‘IRS’ appeals and can help you understand if an appeal is the right decision for you.

Common Questions

1️⃣: Can I Get My Vehicle Back Before The 30 Days?
Yes, it is possible to get your vehicle back. However, it depends on various factors. At Ticket Help, we do free consultations to determine whether this is possible in your case.

2️⃣: Will The Immediate Roadside Sanction Be On My Record?
No, in Alberta, an Immediate Roadside Sanction is a regulatory offence.

This means
* No criminal record🆓
* Consequences are regulatory in nature: licence suspension, vehicle seizure, fines, and mandatory courses.
*Important to know that officers can lay separate criminal charges.

3️⃣: What If I Don’t Appeal?🛑
It is extremely important to know your rights. YOU HAVE 7 DAYS TO APPEAL YOUR SUSPENSION.

4️⃣:Costs of not appealing!
‼️Contravention fine💰
$1200
‼️Towing fee
$2200
‼️Ignition Interlock Program
* $63 to apply
* $150 to have the Ignition Interlock device installed
* $1,260 to rent the Ignition Interlock device for 12 months
* $50 to have the Ignition Interlock device removed
‼️In addition, you may have added cost by being required to:
* ‼️Complete one of the educational courses as part of Alberta Impaired Drivers Program (AIDP), such as Crossroads, Planning Ahead, or Impact
‼️Take a knowledge test or road test to have your driver’s licence reinstated
‼️Increased insurance premiums

Altogether, you could be facing a $4923 bill 📑 and that’s without considering your insurance premiums, or extra costs for additional courses that may be required.

Getting into a car collision can be a scary experience. However, failing to remain at the scene is a serious offence. This falls under both the Traffic Safety Act and potentially the Criminal Code. Penalties range from $5,000 upwards of $25,000 depending on the seriousness of the accident.

What Should You Do?
Stop at the scene of the accident.
Provide your full name, address and driver license to anyone involved.
If the accident results in injury or property damage, report the accident as soon as possible.
If you have hit another vehicle without the vehicle owner being present, leave a note with your information.

What if You Leave?
Leaving a scene of an accident can lead to serious consequences, such as:
7 demerit points
License suspension up to 3 months
Fines
Insurance premiums up to 50 – 100% for the next 3 years.
Criminal Code violation

📑Speeding tickets are often thought to be a simple matter; however, they can be detrimental to your driving record. From financial penalties, demerit points, higher insurance premiums, and potentially risking job security for professional drivers or those insured by their employers. Depending on your speed, the demerits can range from 2 to 4 points.

Why Fight a Speeding Ticket

🫧CLEAN DRIVING RECORD
Having a clean driving record ensures your insurance premiums do not rise. Even one traffic violation can raise insurance premiums, and in certain cases, an individual could be facing a license suspension.

👉DEMERIT POINTS
Demerit points are added to your driving record when you are convicted of a traffic violation. Different violations carry different amounts of demerit points, and these points remain on your driving record for two years. Every class 5 licensed driver can receive 15 points within a two-year period before a suspension occurs. Often, warning letters are issued prior to approaching the suspension threshold of 8 points.

⚠️SUSPENSION
1️⃣. First suspension: One month suspension is applied for accumulating 15 or more demerit points within two years.

2️⃣. Second suspension: If a second suspension is received within a year, the license is suspended for 3 months.

3️⃣. Third suspension: Your license can be suspended upwards of 6 months.

The assumption is that if you committed a traffic violation, you cannot fight the ticket. That is not true. Receiving a ticket is only the first step; the second step is to see whether the evidence before you is admissible. Often, evidence is inadmissible due to errors or mistakes. This can happen from radars being outdated to even minor mistakes made by the officer. At Ticket Help, we demand disclosure from the courts on your behalf. If there are flaws, our legal team will find them and help you either get your ticket withdrawn or reduced.🙌
