Understanding the New Requirements for PGWP Applicants: A Guide for Study Permit Holders
If you are applying for a Post-Graduation Work Permit (PGWP) in Canada, it’s essential to be aware of the new language and field of study requirements that come into effect after November 1, 2024. Whether you submitted your study permit application before or after this date, the rules vary, and you must meet specific criteria based on your program and the timing of your application. Here’s a breakdown of the requirements for each case.

1. For Study Permit Applications Submitted Before November 1, 2024
If you submitted your study permit application before this deadline and are planning to apply for a PGWP on or after November 1, 2024, the primary focus is on proving your language proficiency. Here are the details based on your program of study:

For Graduates with a Bachelor's, Master's, or Doctoral Degree from a University:

Language Requirement: You must demonstrate your proficiency in English or French. The required minimum level is Canadian Language Benchmarks (CLB) 7 in English or Niveaux de compétence linguistique canadiens (NCLC) 7 in French, in all four areas: reading, writing, listening, and speaking.
For Graduates of Any Other University Program:

Language Requirement: The same language requirements apply here. You must achieve a minimum level of CLB 7 in English or NCLC 7 in French in all four language areas.
For Graduates from College Programs or Any Other Programs Not Listed Above:

Language Requirement: If you graduated from a college program or another type of program, the language requirement is slightly lower. You must prove a minimum level of CLB 5 in English or NCLC 5 in French in all four areas.
2. For Study Permit Applications Submitted On or After November 1, 2024
For those submitting their study permit application on or after November 1, 2024, both language proficiency and the field of study come into play for PGWP eligibility. The requirements vary depending on the program you graduated from:

For Graduates with a Bachelor's, Master's, or Doctoral Degree from a University:

Language Requirement: As with applications submitted before November 1, 2024, you must demonstrate proficiency with a minimum level of CLB 7 in English or NCLC 7 in French across all four language areas.
Field of Study Requirement: All fields of study are eligible for this category. There are no specific restrictions on the field of study, making it a broader eligibility range for university graduates.
For Graduates of Any Other University Program:

Language Requirement: You must meet the same minimum language requirement of CLB 7 in English or NCLC 7 in French.
Field of Study Requirement: In addition to the language proficiency, you must have graduated in an eligible field of study. It’s important to ensure that your program aligns with the eligibility criteria set by Immigration, Refugees, and Citizenship Canada (IRCC).
For Graduates from College Programs or Any Other Programs Not Listed Above:

Language Requirement: Similar to the university graduates, you must meet a minimum level of CLB 5 in English or NCLC 5 in French in all four language areas.
Field of Study Requirement: You must also graduate in an eligible field of study, making it crucial to check the IRCC guidelines for accepted programs under the new rules.
What Does This Mean for You?
As these changes roll out, it’s important for international students and prospective PGWP applicants to stay informed. Language proficiency has always been an essential component of Canadian immigration pathways, but the added requirements for fields of study (for applications after November 1, 2024) emphasize the need for students to plan carefully when choosing their academic programs.

Preparing for Your PGWP Application
Here are a few steps to help ensure your application is successful:

Check Your Language Proficiency: Make sure to take a language test (such as IELTS, CELPIP, or TEF) that meets the required CLB or NCLC level for your program.

Verify Your Program's Eligibility (for Post-November 1, 2024 Applicants): Ensure your field of study is eligible for PGWP under the new guidelines.

Stay Up to Date: Rules and policies may continue to evolve, so keep checking the official IRCC website for any further updates on PGWP eligibility requirements.

Conclusion
Canada’s Post-Graduation Work Permit offers international students a fantastic opportunity to gain work experience and potentially transition to permanent residency. However, with the new rules coming into effect, meeting both language and field of study requirements is essential for ensuring your eligibility. Whether you submitted your study permit application before or after November 1, 2024, understanding these changes will help you prepare for a successful PGWP application.

Today, we announced that the Government of Canada will set an intake cap on international student permit applications to stabilize growth, for a period of two years. Details: https://www.canada.ca/en/immigration-refugees-citizenship/news/2024/01/canada-to-stabilize-growth-and-decrease-number-of-new-international-student-permits-issued-to-approximately-360000-for-2024.html

For 2024, the cap is expected to result in approximately 360,000 approved study permits, a decrease of 35% from 2023. Study permit renewals will not be impacted. Those pursuing master’s and doctoral degrees, and elementary and secondary education are not included in the cap. Current study permit holders will not be affected.

To implement the cap, as of January 22, 2024, every study permit application submitted to IRCC will also require an attestation letter from a province or territory. Provinces and territories are expected to establish a process for issuing attestation letters to students by no later than March 31, 2024.

In order to better align the Post-Graduation Work Permit Program, we are changing the eligibility criteria:
• Starting September 1, 2024, international students who begin a study program that is part of a curriculum licensing arrangement will no longer be eligible for a postgraduation work permit upon graduation.
• Graduates of master’s and other short graduate-level programs will soon be eligible to apply for a 3-year work permit.

In the weeks ahead, open work permits will only be available to spouses of international students in master's and doctoral programs. The spouses of international students in other levels of study, including undergraduate and college programs, will no longer be eligible.
