There are several types of parenting arrangements in Alberta. Whether it’s joint, sole, shared or split parenting, these arrangements set out the rights and obligations of parents and guardians. It is important that parental parties have a firm understanding of their Parenting Order and their role within the Order.

For example, Joint Parenting is when parents share in parental responsibilities and make all major decisions about the children together; however, it does not mean that the children live an equal amount of time with each parent.

Prenuptial Agreements are a legally binding contract between a couple who plan to get married. The “prenup” sets out the rights and obligations of both parties should the relationship end. Parenting Arrangements

When parenting custody, access and day-to-day decision making about the care of a child can be agreed upon by a set of parents, a Parenting Agreement should be drawn up by a lawyer to make it legally binding. When parents cannot agree, the Court will make a Parenting Order based on the best interests of the child.

When families are in a period of separation, extended family, namely grandparents can find themselves in uncharted territory when it comes to access to grandchildren. Grandparents in Alberta do not have a right to see their grandchildren. However, in Alberta, the Family Law Act allows grandparents for some possibilities to access their grandchildren when the grandparents and parents cannot agree on contact. An interim separation agreement is usually used at the start of the separation and can set out how the separation will occur. The focus of the interim separation agreement will be on issues that will arise as parties negotiate their separation, with a view to the short term.

An interim separation agreement may cover issues such as:
• The living arrangements for the parties;
• How property will be sold;
• Who will pay for maintenance of the property in the interim;
• What support may be payable until a final agreement is reached; and
• If there are children, how will parenting occur.
